I don’t buy the ‘then we’d all lose it’ argument. I wouldn’t lose shit. I am an American citizen. The people we’re talking about at Gitmo are not American citizens. If they get the same protections we get then what the hell exactly, is the point in being an American citizen?

It a constitutional issue according to the courts. Congress can vote to suspend habes corpus in extreme cases, but it will apply to all, you can’t just suspend it for some. It’s a 600 year old concept, dating from the Magna Carta.
