The “fetus” statute very obviously does NOT apply to the case in question. The baby was newborn, it was not a fetus.

And also, note this wording:

A. Any person who unlawfully, willfully, deliberately, maliciously and with premeditation kills the fetus of another is guilty of a Class 2 felony.

This mother is being accused of killing her own newborn baby — NOT “the fetus of another.”
