My guess is that he is (actually a serving officer in the military) because the person(s) attempting to make the case have been turned down by the courts before, for reasons of standing… so they have been looking for an active solider (who would then be in service to the CIC) to claim a legitimate standing. I am not a lawyer, but I think that is the idea.

But, yes if he is for real he is in trouble.

I don’t think he is real. I admit I could be wrong, I have been in the past. But this seems to be way out there. No mention of his branch of service, his specialty, his unit, his location in Iraq, etc. And the story about not enlisting until he was 40 sounds a bit odd also. While the military can take people up to and including age 46 now at a first enlistment, most services do not with the exception of medical people. At age 40 there is no way you are going to last for a career and go to age 60 and the military knows that.
