I’m afraid there is much wishful thinking going on. The value of the stolen Swishers is irrelevant. The key evidence of the convenience store video is that it shows Michael Brown laying his hands on that clerk and moving toward him in a threatening manner. It kills the gentle giant narrative dead. He is twice the size of the clerk who is clearly fearful. You can bay at he moon that this is not relevant but it is. It isn’t minformation. It’s the truth. And it very likely did figure in later developments. Who knew what and who didn’t matters. So will all subsequent forensic evidence. That’s what a jury is going to see and hear and it is all that matters. The weight that any jury gives to the veracity of witnesses and what Michael Brown might have done will be influenced by it. And since the only person likely to find himself on trial is the officer no judge will be able to deny the use of this evidence to the defense.

In other words, “Derp.”
