Nirth certifikit Troofers strike out at the Supreme Court: Court won’t review Obama’s eligibility to serve.

Imagine my surprise. The Troofers are probably conference-calling about this right now.

WASHINGTON (AP) — The Supreme Court has turned down an emergency appeal from a New Jersey man who says President-elect Barack Obama is ineligible to be president because he was a British subject at birth.

The court did not comment on its order Monday rejecting the call by Leo Donofrio of East Brunswick, N.J., to intervene in the presidential election. Donofrio says that since Obama had dual nationality at birth - his mother was American and his Kenyan father at the time was a British subject - he cannot possibly be a “natural born citizen,” one of the requirements the Constitution lists for eligibility to be president.

And by the way, the kooks have a name for sane people who want nothing to do with their nuttery: “anti-Constitution.” Isn’t that lovely?

Fine, but I do have a question. If I can't challenge the candidate before the election because I have no standing, and I can't challenge him after the election but before the meeting of the electoral college, and the only people that can challenge him after the electoral college vote is Congress, how do we enforce the Constitution?

Lets say I am from the Californica Barking Moonbat Party and I nominate the Arnold for president. He appears on the ballot like the illegal did in NJ and low and behold he gets a majority of the votes in the electoral college. Now it just so happens that Congress is controlled by elements of the Californica Barking Moonbat Party. We now have a POTUS who is patently not eligible to serve but who is serving anyway. If the Constitution is to mean anything, an independent agency of some sort has to verify the bona fides of the candidates for president and congress.

We lacked standing before, we lacked standing after and Congress will do nothing. This is not to say that the 0bama is not eligible to serve. He may be. If not it will come out sooner or later.

CNN has been reporting about the "Leftist" anarchists rioting in Greece. The CNN "news" desk person asked a CNN "reporter" (on location) about the age of the rioters...The CNN on location "reporter" repeated that it was "youths" doin' the rioting...and it was anarchists.

The poster here at LGF, Cagey (?) noted that this isn't the case -- the riots are due to asylum seekers.. I did a brief check on-line. That it's about the asylum system in Greece appears to be the case...which, interestingly, is not being reported by the MSM in North America.

OK, not to sound dumb (and I am certainly not a truther - God forbid)...but why shouldn't candidates have to prove that requirement before they file the forms for the office? Does this now mean that non-natural born citizens can now run since its 'stupid' to ask? I know people think this is wrong since its being done only by the nut-rolls, but as time goes on this could become a real weak point in the system. Requirements mean nothing if there is no process for validation. So where do we go from here?

Actually, I thought the Federal Election Commission was the right place to determine this, as they could then contact the states and let them know that the candidate was ineligible. Am I wrong?

Some of those "kooks" believe in the movies that when a slumlord replaces a light bulb in a dilapidated building, all of a sudden in the next act, the slumlord turns good and the whole building is renovated.

The point being, if something as so simple as a birth certificate determining eligibility for an elected office cannot be judged by a court, what else will the court pass up that has direct constitutional impact?

Barack brought this on himself by never answering the question directly, using proxies to fill in the gaps. As far as I'm concerned, his mother was American thus he's American and we're stuck with that ID 10 t kit for the next 4-8 years.

Actually, his eligibility to serve rests more on later events in his life than in his birth certificate. Yeah, being born in Kenya would kill him, but for the sake of argument, let us say he was born in Hawaii as he claims. The critical events are when he turns 18 and after that. He actually does not forfeit his US Citizenship when he is in Indonesia since he is a minor, as I once thought he did. Digging into the legal compost pile, a person born in America and then brought abroad and then returned to the states maintains the potential for his natural born status providing he does not do anything beginning at or after age 18 to affiliate himself with the foreign country. If 0bama put down his citizenship on his college apps as Indonesian or Kenyan, or traveled on an Indonesian passport, that would be regarded as an act of affiliation.

CNN has been reporting about the "Leftist" anarchists rioting in Greece. The CNN "news" desk person asked a CNN "reporter" (on location) about the age of the rioters...The CNN on location "reporter" repeated that it was "youths" doin' the rioting...and it was anarchists.

Well there are certainly groups who will join in to make it worse as always JS, think it's more a sign of current dilipidated economic conditions. In the background lots of looting is going on in those shopping districts, but they aren't reporting that, the "malcontent anarchists" angle is sexier than thievery.

As much as I don't care for bailing out the union, if we don't, then we lose this round. Japan, Germany, France, China, etc are all bailing theirs out, and not even making it a loan, but just a payment. I have more of a problem with the bailouts for the banks. There's absolutely no oversight on those, and they aren't doing what they're supposed to do, lossen up the credit markets. At least the automakers have a history of repaying government-backed loans.

It's not just our automakers in there either. All of them are in trouble. For example, word is Honda is in really deep financial trouble that makes even GM look good. GM is still in NASCAR. Honda pulled out of Formula 1.

Of course, all this could be fixed if the bank bailouts worked as claimed to unfreeze the credit markets.

Judging by the little scene going on in Chicago right now, I'd say that that the banks have taken their bailout and are sitting on the cash. One thing this controversy has brought out - people are checking their own birth certificates to see if they are correct.

Nowadays birth certificates are generated by computer from a database where the data were posted by a HUMAN [read: can be error prone]

I recently had gotten a copy of my birth certificate and on close examination found that the certificate had my name spelled WRONG. So now I reverted back to using my old, tattered copy which has everything correct because it is filled in by hand. Apparently the data enterer couldn't read the script.

So, people check your Nirth Certificates! Birth certificates.

Good lord, that is the most ridiculous thing I have heard in, well the last week. That makes no sense whatsoever. Those designations are part of your birth record, and therefore your legal name. Leaving off that designation would seem to me to cause a problem, not using your full legal name, which is required.

Judging by the little scene going on in Chicago right now, I'd say that that the banks have taken their bailout and are sitting on the cash. I don't think they have a handle enough on what happened to their balance sheets or how the bailout money will help them. So they will cancel/deny/reduce lines of credit, which are the operating capital avenues for small business. Big Bank is not only ripping us off, it's got its foot on the pedal of this recession.

My bank contacted me regarding a no interest credit card that I qualify for. Wanted me to transfer the balance of my car loan to it.

The DC politico mantra is to do anything even if it is stupid and shortsighted. If they do nothing, then they can be held accountable for doing nothing. If they do something, even if that something is incredibly dumb and naive, then it is not their fault but how it was implemented. So, they toss good money after bad, keep their contributors happy.

ex. Illinois Gov has ordered all State Agencies to stop doing business with Bank of America since BoA shutdown the Republic Window Co line of credit (their revenues dropped 40% making it uncertain if they could pay) and caused the company to fail tossing about 400 union members out of work with little to no severance. The Gov is making the bank the scapegoat and is using state agencies to extort the bank to tossing money at a company that is not fiscally viable in order to keep the union happy. Why not, the Fed's will bail out BoA...right?

The fiscal problem started when the government under Carter and Clinton, for political reasons, buggered with the free market to make sure those who could not afford a home could buy a home. From that point on, it was all downhill- particularly when the shenanigans at Freddie / Fannie / Countrywide were exposed and their house of cards collapsed.

Buck, I haven't "ignored" anything. I thought the debate was about "can we check the document." I was under the impression the 0bama people said "no." I guess I missed the news story of the document being allowed to be photographed for us all to see. Which is weird, b/c 0bama argued in court it was private and no one should see it. So, I'm still confused, though not about his place of birth.

BTW, if anything is completely crazy, it the notion peddled by fake conservative Horwowitz on the next thread that the "natural born" requirement is just some silly technicality.

Far too many companies have a Board of Directors that are nothing but a rubber stamp for the CEO -many with too many members who are also employees of the company. Board of Directors need to provide the role of being the oversight / check and balance to the actions of the CEO.

I think that Obama and his advisers are pretty darned smart. I think they would like to drag out this Birth Certificate nonsense as long as possible to discredit conservatives and Republicans as much as possible with it.

This is a very dangerous time for conservatives. Obama's inner circle is not a bunch of yahoos. They are Alinsky devotees. They know how to play guerrilla politics better than any conservative ever has. Conservatives will have to step up their game substantially.

I can understand average Kenyans getting all excited about an American president of Kenyan extraction because they are, by and large, an ignorant bunch who heard that rumor and ran with it.

AND YOU ARE WRONG...The Certificate of Live Birth. is a perfectly legal document. The document is his birth certificate, and HAS been presented outside of DailyKOS.

AND it meets all of the requirements from the State Department for proving U.S. birth and citizenship.

The state created the document. That makes it his real Birth Certificate. It refers to where he was born as the county of Honolulu.

Here is the problem I have with this.


From what I read, every single time a citizen in a state questioned their own secretary of states weather they verified Obama's eligibility to be on their state ballot, the state officals all said 'it was not their job' which is WRONG. So none of them every checked ANYTHING for presidential candidates. But if you ran for Senate, Congress, State Dog Catcher etc..they would all require proof. Mind boggling.


The problem is that all the state officials claim it was not their responsibility, and no one at the federal level is willing to at least take a look at it either.

Everyone from top to bottom just shrugs their shoulders and seems to say 'meh'.

That means that you effectively have to produce ZERO PROOF to anyone that you are actually eligible to be president. You would never ever get questioned or caught even if you were lying through your teeth.

The only possible thing that could legally happen is that you get elected, and then the congress actually decides to impeach/convict you.

Its mind boggling that no one even cares to do the sort of basic paperwork required for other offices for the Pres/VP.

BTW, now that Obama has shown just how piss poor things are, just wait for someone to try and actually get away with something.

ACTUALLY...one of the problems with no one questioning this stuff is that this is in fact TRUE.


Hawaii Revised Statute 338-178 allows registration of birth in Hawaii for a child that was born outside of Hawaii to parents who, for a year preceding the child’s birth, claimed Hawaii as their place of residence.


There are lots of ways to get 'citzenship' for those that are born outside the US, even outside of military bases etc..

So, you can be a citizen, get a new COLB from your home state, but still not a 'natural born' citizen. (aka born on American soil).


Of course, how dare we question what not a SINGLE secretary of states or states board of elections or anyone else in the country never bothered to even ask about.

The fallacy in your argument is the misinterpretation as 'natural born' as requiring birth on US soil - the definition does not mean that. It means that someone who is born as a citizen of the US under the qualifications that makes one an American at birth. It clearly, and there is no debate about this, disqualifies any naturalized citizen since they were not naturally born a citizen. As long as one's parents are US citizens and pass that citizenship immediately to the child at birth, then the child qualifies as natural born.

(c) The fee for each application for registration shall be established by rule adopted pursuant to chapter 91. [L 1982, c 182, &sect1]

According to Hawaiian law:

So an amended Hawaii birth certificate should show place of as Kenya, were it in fact Kenya. There is no reason for the short form to differ. As Obama's says Honolulu, that means he was born in the USA and is a "natural born citizen" of the United States.

Number one that is for OUT OF STATE, not foreign born.

NUMBER 2 do you see the 1982 date on that? For it to be relevant then it would have to be before 1961.

Number 3 It will not show the place of birth to be anything other than the true place of birth. Again anything otherwise would make it very popular with the 8 million illegal aliens residing in the USA, and would give anything for a birth certificate that say they were born in the USA.

That is why it says "that he or she may deem necessary or proper to prevent fraudulent applications for birth certificates". If a birth certificate says place of birth is Honolulu but it really is Kenya... that would be fraudulent.
