What’s this I hear about people ripping off Iowahawk’s goods?
The Pelosi GTxi SS/RT, Take 2.
Maybe they need to have a discussion with the business end of Stinky Beaumont’s wrench.

Not "plagiarism": copyright infringement.
And yes, it's illegal.
At the risk of repeating myself... It's only illegal if you're not a democrat.

In the Case of the "flaming fat thieving douchebag at KFMB San Diego," he claimed it as his own work, so "plagiarism" works for that one too.
Some time today, he removed the ripped-off post. If you follow the link from Iowahawk's site it redirects to the front page now.

It would be hard. The MSM would defend the Dem and if they stole the work from a Republican the media would argue that the work had been 'cleansed of evil' not stolen.

"Plagiarism" describes the act; "copyright infringement" describes the legal cause of action.
To be prosecuted for copyright infringement, one must bring a civil suit against the infringer. There are no Copyright Police; enforcement is a private matter over 90% of the time. Yes, the Copyright Act provides for certain criminal penalties, but they are rarely enforced.
Sad but true.

Calling him a 'plagiarist' works as a kind of "civil shaming" mechanism, though. It got the radio station to remove it, and probably got the douchebag in hot water, because no media company wants to be accused of the P word.

Emperor Norton Wed, Dec 24, 2008 6:10:44pm |
If Mr. Iowahawk wants to stop the unauthorized use of his work, he should not post them on the internet, where anyone with computer can see them. However, copyright suits are easy for the plaintiff to win if the copyright is registered, but dangerous for the defendant, since he must usually also pay the plaintiff's legal fees if he loses.

Earlier this year I had a post goofing on Obama that was widely linked. I got an email from a lefty blogger saying how she liked it and asked whether I wanted to crosspost at her site, which is well known, for rather dubious reasons, I might add. I politely said thanks, but no thanks, feel free to link, but no way am I posting there.
I go out for the night and forget about the whole thing. The next day I get an email from a friend asking me what the hell I was doing posting at that site. So I go there and see my name, an introduction from "me" saying I was now blogging there, and my original post cut and pasted in along with a bunch of links from other sites that had linked me.
So I write to this woman and tell her to take it down. She refuses. I write again and told her what she did would be my very next post explaining to all what kind of stunt she just pulled and I would make her life a living hell. She got all bitchy at me but finally removed my name.
A while later, she actually had the nerve to ask whether I wanted to post something there again. She was told in no uncertain terms to lose my email.
It's one thing if some completely obscure site posts your material, so long as you get credit. It's entirely another when someone pretends it's actually you posting there.

re: #83 buzzsawmonkey
I have to sign off, but in parting:
1) If Iowahawk has not registered his work with the Copyright Office, he should do so immediately. The "Congressional Motors" piece is still within the 3-months-of-first-publication grace period.
2) He can register his entire year's output on one set of forms, with one fee of $45, if he uses a Form TX (currently being phased out, but still downloadable on the Copyright Office website) WITH an adjunct Form GR/CP, which stands for "Group Registration of Contributions to Periodicals." Iowahawk's website is a "periodical," so he can register all his text using these two forms combined.
3) Once the work is registered, and the infringed piece is registered within the 3-month grace period, he can explore his legal options, should he wish to. But he should register first.
Can't you just put a copyright notice at the bottom without registering? I always thought that one had a right to copyright without registering.

Blog Plagiarism Q&A
We bloggers generally pride ourselves on uniqueness and creativity. We get a rush when we see others linking to our posts and reading our feeds, since it usually means that they find value in what we have to say. Unfortunately, not everyone who reads your blog does so for legitimate reasons. Some unscrupulous individuals in the blogosphere are only out to scrape your content for their own websites, ripping off your material and claiming it as their own.
Interesting read.

You have the option to block the offending site, temporarily, under the DMCA--if you contact the site's ISP. If the ISP doesn't do it, the ISP--not the site--is liable for the infringement.
I didn't pursue anything further once my name was removed. If you want to link me, fine. I just didn't want in any way to be associated with that site outside of being linked. You can't control who's going to link you, obviously. I get linked at plenty of lefty sites taking swipes at me. No big deal. But don't create an ID for me and pretend it's me actually blogging there. That was way over the line.

Some unscrupulous individuals in the blogosphere are only out to scrape your content for their own websites, ripping off your material and claiming it as their own.Interesting read.
Thanks!

Guilt ridden liberals to pay voluntary penance...
Guilty About Flying? SFO To Offer Carbon Credits
San Francisco International Airport is planning to give guilt-ridden travelers a chance to offset the air pollution emitted from their plane rides.
The airport says it will set up a series of kiosks that will allow travelers to purchase certified carbon offsets. The city of San Francisco, the airport and a carbon-reduction investment company, 3Degrees, plans to roll out a pilot program this spring.
Travelers will enter their destination into the kiosk, which will calculate the amount of carbon dioxide for which they are responsible, and the cost of offsetting it. After swiping their credit cards, they would get a receipt listing the exact carbon-reducing projects their money went to.
Voluntary taxation? Brilliant!

There's no predictability. IndyMac was allowed to go belly up. Wachovia was forced to merge. Citi got a bailout. What's the difference?
I've heard it argued that Obama can't be any worse than Bush on economics. Paulsen is a deal maker; Volcker and Summers are policy wonks. Business may not like what they do but will know what to expect.

Having been the target of copyright thieves, and working with writers, authors, and photographers on copyright protection and laws for over 25 years, I thought I’d talk a little about what to do when someone steals your content.
First, you noticed that I didn’t say “if” someone steals your content. That was on purpose. With the glut of information on the Internet, it’s now a matter of “when” not “if”.
The first step in learning about what you can do when someone steals your content is to know that it will happen, so the more prepared and informed you are, the better your chances of prevention and having a plan in place when they steal.

Totally OT and driveby post on this Christmas Eve, but just wanted to say MERRY CHRISTMAS to all the lizards! My hubby sent this to me...don't know if it's been posted already, I'm sure someone will let me know...
'Twas the bailout before Christmas, and people said with a gasp,
“Hey look, is that a stock market collapse!?”
The Big Three CEOs skulked like rats from their lairs,
And begged, hoping billions soon would be theirs!
The bankers meanwhile nestled snug in their beds,
While taxpayer dollars danced in their heads!
The citizens were stunned, like lemmings in May,
Wondering how much more would be taken away!
The dollar it plunges, the deficit soars,
Investment capital is fleeing our shores!
Illegals pour in, we’re treated like pawns,
We’re told time and again we can’t tend our own lawns!
Down savings, down home price, down 401K,
We “hope” to have “change” left at the end of the day!
And just when we thought our fate hadn’t been sealed,
They sell us a t-bill with a negative yield!
When down on the Senate floor there arose such a blather,
(We’d not heard such hot air since the demise of Dan Rather!)
And to no one’s surprise, we learned in a flash,
They’d voted again to spend more of our cash!
Bush now rides off, he’s made all of us cringe,
Now he’s spending our money like a Dem on a binge!
Printing more money and priming the pump,
The Fat Cats are certain of remaining quite plump!
"On Obama! On Biden! On Pelosi and Ried,
From fiscal restraint, you now have been freed!
Raise taxes, raise rules, regulations and fees,
Keep it up ‘til the last oil company flees!"
Tax coal, tax carbon, bid Hummers adieu,
Tax natural gas, electricity… hell, oxygen too!
Away Iraq and Iran and Guantanamo Bay,
“Please some one, just make it all go away!”
We just want our Hi-Def and “Dancing with Stars”,
We buy iPods and Wii’s, heck who needs new cars?!
We trust for some reason those running our government
Never mind who got us in this predicament!
This trust is quite odd, it defies all good reason
For they become more corrupt, as they develop more “season”!
But we just keep electing them, though we’re never sure which
Will defiantly stand as our next Rod Blagovich!
Way back when we were free to “speak” and “believe”
We’ve been shoved overboard now with one mighty heave!
Yes, the times there are changin’, or so it would seem,
Your government is now one big Ponzi scheme!
The old days they are over, yes this much is clear
The politicians'' response: “Send your money here!”
So don’t look back even once, just embrace the new way.
Perhaps buy a Senate seat off of eBay!
Then when all seemed lost, came a man with a sack,
His eye’s how they shifted, like coal they were black!
His bag it reads “TARP,” he doles out cash where most bleak,
‘Til he changes his mind again early next week!
He moved away from the light, not unlike a thief,
“We’re about to get screwed” was our common belief!
But I heard him exclaim, as we shouted our beef,
"Happy Bailout to some!” Our reply, “Oh Good Grief!"

Unfortunately for Illinois, that argument doesn't fly between Downstate, The Collar Counties, and Cook County/Chicago. Cook is populous enough to balance the Collar Counties and Downstate. All it takes is a few dead people voting, and viola, you have Dick(head) Durbin and Barack Obama.

Any bets he'll get off with a slap on the wrist? Probation, a minimal fine, and time in a low security facility with a chance for early parole.
I ain't puttin $$$ on that...I spent enough money in the last 72 hours...

My English teacher pounded into use the main styles used in education.
60% of the students hated her guts, she was relentless. Our research, our attribution everything. Had to be just so. Our English too.
I loved her, when a prof asked for a research paper, I'd ask what style, and was ready to go. She had pounded the mechanics of writing a paper into our heads, at least the ones that did what she wanted, so that we could just write the paper all the other stuff was automatic.

I'm just taken aback; what kind of management were they using?
Remember, please, that I'm in nonprofit world. You have a trust account, and a completely separate investment manager. The trust account always shows what your actual holdings are; while your investment manager may have authority to buy and sell, under board supervision, you actually track your holdings at all times.
I don't understand exactly how this could have happened. Wasn't there anyone on the board asking what the Foundation actually held?

I thought I would share this with you guys as an example of what now is considered politically correct "best wishes for the season". From an email I received as a member of a listserve:
Just to cover all bases, please accept with no obligation, implied or implicit, my very best wishes for an psychologically positive, environmentally conscious, socially responsible, appropriately gender-neutral celebration of the Northern hemisphere winter solstice holiday, practiced within the most enjoyable traditions of the religious persuasion of your choice, or within the secular practices of your choice, with due respect and tolerance for the religious/secular persuasion and/or traditions of others, and/or their choice not to practice such religious or secular traditions at all. I also wish you (and extending these wishes to those with whom you have genetic or housing-associated commonalities) a fiscally successful, personally fulfilling, socially gratifying and medically uncomplicated recognition of the onset of the generally accepted calendar year 2009, but not without due respect for the calendars of choice of other cultures whose contributions to society have helped make this country (Australia) great. Of course this is not to imply that Australia is necessarily greater than any other country, nor the only country on the planet Earth, but merely to indicate that this country (Australia) is my personal abode of choice, and that I personally hold great fondness for the aforementioned country. Please note that this wish is made entirely without regard to the race, creed, color, age, physical ability, mental health, personality, specific character strengths, attribution style, religious faith or sexual preference of the wishee, and that this wish holds no (implied or explicit) warranty for positive outcomes during or after the commencement of the generally accepted calendar year 2009.

Oh, and a very MERRY CHRISTMAS to all of you! :-)

He and I have a pretty good vocal thing going. Overall we're getting to be quite a tight little acoustic trio right now. A bunch a math profs that sorted me out in that area, I'm truly hopeless in math. With their foundation I made it through Linear Algebra and Vector Analyses.
A Biology Prof. who taught how to analysis not just repeat what he said.
A Chemistry prof who made his class a blast, both literally and figuratively.

Heh, as the Instapundit might say. :)
CAN YOU HEAR the grumbling over in what Howard Dean used to call "the Democratic wing of the Democratic Party?" The tolerance-and-diversity crowd is upset with Barack Obama; it seems the president-elect has been bringing people into his circle who don't agree with them on every single issue.
[...]
1. It's never advisable to fall in love with a politician; sooner or later, you're bound to feel betrayed. While Obama's true believers may be feeling jilted, can they really claim he gave them no warning? After all, once he nailed down the Democratic nomination in June, Obama began backing away from one liberal stance after another: on banning handguns, on NAFTA, on Iran, on warrantless wiretapping, on public financing of the presidential campaign, on the death penalty for child rape - even, eventually, on the desirability of swiftly withdrawing US troops from Iraq. He was not the candidate of left-wing ideological purity: Could he have put it any more clearly?
2. Actually, he did put it more clearly. He ran explicitly against believing "that we're doomed to fight the same tired partisan battles over and over again" and in favor of changing America into "a country that no longer sees itself as a collection of Red States and Blue States." However one-sided his voting record in Illinois and the US Senate, he pledged something different if he were elected president. For now, at least, he's making good on his pledge.
Go read the whole thing; there are a lot of links to moonbats' whining that will make your week just a little bit better.

Madoff took in a lot of people, he target Jewish organizations, and a lot bit.
They should have never put all their eggs in one basket.
Lesson learned I hope.
Oh, I hope so. But I know non-profit management, and I'm appalled.
This wouldn't have happened if they'd adhered to best practice. Someone made this terrible decision, and that someone needs to pay for it.

Ploome, you're quite right about the yields.
But - I speak as a denizen of nonprofit world - one does not, ever, place one's assets in the hands of an investment advisor. One has a trust account, and pay a fee to an advisor, who has authority to buy and sell, but not to actually touch the endowment.
It simply is not done.

When I taught Hostage Behavior at the prison I would bring up the story of the woman who got her hostage taker to give up by serving him pancakes and talking about the book The Purpose-Driven Life. The point I was trying to impress on my students was "try and improve your situation", if the hostage taker has kids talk about your kids. If he is a Cowboys fan talk up the Cowboys. (This is where Redskins fans say they would rather die.) Anyway she got away by convincing him to give himself up. I later learned that she also shared her meth with the perp. Still, whatever works, as long as lives are saved.

hey all lizards online xmas eve, how about a little plumbing emergency! I'm down visiting Mom, who had the plumber out for the fifth time in a month to look at the kitchen sink, and said we should just leave it open for a week, spilling water onto the walkway along the side of the house.
Well, guess what, it's not just the kitchen, it's the main. And the regular plumber can't even handle that, he tells us to call Roto-Rooter - who will come out right now, at premium. But, well, it seems it's still flowing at 10% or so, so if we're careful on the water, we can wait until Friday.

Times are tough, especially The NYTimes.
The Journal report comes on the same day that the Times Co reported a 20 percent drop in advertising revenue in November, compared with the same period last year...
Debt is proving difficult for many U.S. publishers to handle because they are bringing in less cash to make them able to meet their obligations. This is partly because of the fading relevance of printed newspapers to people now used to getting news for free online. The world financial crisis has only worsened the ad sale declines.

re: #374 itellu3times
hey all lizards online xmas eve, how about a little plumbing emergency!
Idiot plumber to put us in this situation.
Um, anyone have any particular advice, for this situation?
Life, huh?
Water is coming for the main line?
Between the meter and the house shut off?
Or is it a line going to the sink?
Frankly if there is that much water it's worthwhile getting it fixed ASAP and paying the freight. If you let it leak that long the water damage to other areas of the house could easily cost more than paying the premium for an ASAP fix.

re: #376 ploome hineni
what is a trust account?
at some banking/investment house like Credit Suisse or Morgan Stanley?
This is a little complicated, but: a trust account should be held by a major institution, not an investment house. In other words, a separate, pretty much untouchable account at your bank.
To put it in an investment house is just...wrong. Not for a private individual, but for a foundation.
Foundations are - or are supposed to be - perpetual trusts. A board exists to serve the money in the trust, not vice-versa.

I don't know how long hes been on vacation vs how long the clip was up. I haven't listened to Rick Roberts since I haven't had any classes at O-dark-30 in the morning for quite some time. That being said: It would not surprise me one bit if the whole thing, from the theft in the first place to the amateur memory hole job was the doing of "producers" who often, in local talk radio, tend to be less professional than the title makes them sound.

House side of the meter the home owners.

Before the year ends, let's remember the kind of people Obama hangs with..
O PASTOR IN SEX SCANDAL
September 9, 2008
He almost wrecked Barack Obama's presidential dreams, and now firebrand pastor Jeremiah Wright has helped destroy a Dallas church worker's marriage - and her job, The Post has learned.Elizabeth Payne, 37, said she had a steamy sexual affair with the controversial, racially divisive man of the cloth while she was an executive assistant at a church headed by a popular Wright protege.
This is the sort of moral pool that Obama swins in, has always swam in. He has more scummy people for best friends that anybody I ever heard of.

re: #397 ploome hineni
major institution like what?
and these 'trusts' are not for individuals?
Well, most foundations that I'm acquainted with use a major bank. Out here on the West Coast, that would be BofA, Wells Fargo, or someone like that. A Trust Agreement is signed, and that means that, while the bank will receive a fee, and any interest, dividends or principal payments will go through the cash accounts, they merely record and track holdings - in this era of electronic records, that means that the holdings are recorded by them, though it used to mean that they held the actual paper certificates. These days, those certificates are "held" by a central repository, and I have deep and unhappy doubts about that situation. But, and this is important, the bank has no control over the assets. That's why it's a trust.
Individuals can have trust accounts. But I know absolutely nothing about that side, as (pretty obviously) I don't have that kind of money.
The point is, no foundation should leave its assets where they can disappear into thin air: that is, one does not - ever - leave the assets in the hands of the investment advisor.

Huh. Seems to me the idiot plumber shoulda known it was not just from her sink (caveat I know next to nothing about plumbing) but iirc, in most states Plumbers have to be both Licensed and Bonded or insurerd. If it were me, I'd have Roto-Rooter come out NOW - even at a premium and then charge the plumber; if he hadn't misjudged the situation in the first place you wouldn't have had to a) pay him and b) wouldn't have to pay Roto-Rooter (though I'm confused as to why the plumber can't fix it but Roto-Rooter can).

Yes, the main sewer to the city street. No water leaking anywhere, as long as I keep the plug in the 2" access, but it seems any running water in the house or garage, backs up - and apparently, slowly drains.
Holiday Inn up the street has rooms for $99, if need be, but elderly Mom is disinclined. My brother and son were going to stay over, we redirected him for this night, since he was going to arrive late anyway.
Why does this always happen on only the worst night of the year?

That occurs to me, too, and I dunno either. Regular plumber is an idiot, not worth going to court for. We could probably afford the premium without too much fuss, but it doesn't seem a crisis, as long as we keep the flushes to a minimum. So far. If it gets worse, we call for immediate service, and see about billing it back to the idiot.

It's the grating of the carrots that impresses me!

SO... if you know Biden has a "record" of plagerism... why do you ask about Biden? You confuse me yet again.

Oh, and BTW - Merry Christmas, to you and the Quilly clan! I append my Male's good wishes as well, since he is barred from the Bar.
Same to you and your Male. Thanks ever so much. I don't post much on the Bar anymore.

Sounds like the drain pipe from the house to the main sewer is plugged. Gotta get Roto Rooter. The plug is probably within 100 feet of the house. Tree roots have a way of invading drain pipes and then "stuff" starts to dam up.
maybe but that usually doesnt happen sudden like...and that's way below ground

I don't lurk there much, so I didn't know.
I assume you're busy, of course.
We definitely wish you and yours a happy new year, and if you're ever out here, please drop by. You used to have my email, I know, but if you've lost it, you'll be able to find me here.
Unless, of course, I somehow lose my mind and cause Charles to ban me.

re: #460 WindHorse
The balance of my comment should have cleared that up for you: "HE wasn't mentioned by Iowahawk. So I assumed we'd drifted off topic and were discussing some new revelation about Biden."
See the topic of the thread was how Iowahawk had been plagerized, so I read Iowahawks piece and didn't see Biden mentioned so assumed that when JCM said "Biden has a history" he wasn't talking about plagerizm.

While I was foing care taking work, we used Roto Rotter on 90% of our plumbing emergencies. One thing about Roto, Rooter, is when they fixed something, it stayed fixed.
That sounds good.
Are they pricey, should I worry that I'm not getting a couple of bids? Seems like half our local yellow pages is full-page plumbing ads.

That's probably it.
Now, Mom says there's a cleanout plug burried at the back of the house. Burried!?!? A little poking in the dark, hasn't uncovered it. I guess we just tell the plumber, and hope they can find it. Wish I was in better shape or more of a do-it-yourselfer.
Thanks all for advice and good thoughts.
"shoot yer sink" sounds like good advice, too.
