What’s this I hear about people ripping off Iowahawk’s goods?

The Pelosi GTxi SS/RT, Take 2.

Maybe they need to have a discussion with the business end of Stinky Beaumont’s wrench.

Some time today, he removed the ripped-off post. If you follow the link from Iowahawk's site it redirects to the front page now.

To be prosecuted for copyright infringement, one must bring a civil suit against the infringer. There are no Copyright Police; enforcement is a private matter over 90% of the time. Yes, the Copyright Act provides for certain criminal penalties, but they are rarely enforced.

If Mr. Iowahawk wants to stop the unauthorized use of his work, he should not post them on the internet, where anyone with computer can see them. However, copyright suits are easy for the plaintiff to win if the copyright is registered, but dangerous for the defendant, since he must usually also pay the plaintiff's legal fees if he loses.

Actually, Dick Morris said the same thing as Roberts and on that point I think they're right. The bailout was done poorly and in haste, and it does not not adhere to any free market standards I know of.

Earlier this year I had a post goofing on Obama that was widely linked. I got an email from a lefty blogger saying how she liked it and asked whether I wanted to crosspost at her site, which is well known, for rather dubious reasons, I might add. I politely said thanks, but no thanks, feel free to link, but no way am I posting there.

I go out for the night and forget about the whole thing. The next day I get an email from a friend asking me what the hell I was doing posting at that site. So I go there and see my name, an introduction from "me" saying I was now blogging there, and my original post cut and pasted in along with a bunch of links from other sites that had linked me.

So I write to this woman and tell her to take it down. She refuses. I write again and told her what she did would be my very next post explaining to all what kind of stunt she just pulled and I would make her life a living hell. She got all bitchy at me but finally removed my name.

A while later, she actually had the nerve to ask whether I wanted to post something there again. She was told in no uncertain terms to lose my email.

It's one thing if some completely obscure site posts your material, so long as you get credit. It's entirely another when someone pretends it's actually you posting there.

Nope, no free market standards I know of either. It's shocking to watch the financial sector just get, no questions asked, no restrictions required, but anyone else who wants a loan has to come begging on bended knee.

I have to sign off, but in parting:

1) If Iowahawk has not registered his work with the Copyright Office, he should do so immediately. The "Congressional Motors" piece is still within the 3-months-of-first-publication grace period.

2) He can register his entire year's output on one set of forms, with one fee of $45, if he uses a Form TX (currently being phased out, but still downloadable on the Copyright Office website) WITH an adjunct Form GR/CP, which stands for "Group Registration of Contributions to Periodicals." Iowahawk's website is a "periodical," so he can register all his text using these two forms combined.

3) Once the work is registered, and the infringed piece is registered within the 3-month grace period, he can explore his legal options, should he wish to. But he should register first.

Can't you just put a copyright notice at the bottom without registering? I always thought that one had a right to copyright without registering.

I didn't pursue anything further once my name was removed. If you want to link me, fine. I just didn't want in any way to be associated with that site outside of being linked. You can't control who's going to link you, obviously. I get linked at plenty of lefty sites taking swipes at me. No big deal. But don't create an ID for me and pretend it's me actually blogging there. That was way over the line.

The airport says it will set up a series of kiosks that will allow travelers to purchase certified carbon offsets. The city of San Francisco, the airport and a carbon-reduction investment company, 3Degrees, plans to roll out a pilot program this spring.

Rick has done a lot of good things in this state, especially with respect to help passing legislation that toughen the laws against child molesters.
I'm not making excuses for him.

He deserves whatever happens to him but it still kills me.

My English teacher pounded into use the main styles used in education.
60% of the students hated her guts, she was relentless. Our research, our attribution everything. Had to be just so. Our English too.

I loved her, when a prof asked for a research paper, I'd ask what style, and was ready to go. She had pounded the mechanics of writing a paper into our heads, at least the ones that did what she wanted, so that we could just write the paper all the other stuff was automatic.

Remember, please, that I'm in nonprofit world. You have a trust account, and a completely separate investment manager. The trust account always shows what your actual holdings are; while your investment manager may have authority to buy and sell, under board supervision, you actually track your holdings at all times.

I don't understand exactly how this could have happened. Wasn't there anyone on the board asking what the Foundation actually held?

Very nice...your style reminds me of someone my hubby and I jammed a lot of originals with way back in the 80's when we had nothing better to do than jam our brains out! I played bass and hubby played drums, now I'm on guitar and he's on bass, doing a lot more acoustic and bluegrass style stuff with a friend of ours who plays guitar and harmonica. He and I have a pretty good vocal thing going. Overall we're getting to be quite a tight little acoustic trio right now. I'm going to be working on posting some video on youtube in the next few days of us jamming on the 5th of July (hung over and all)...I may or may not post a link here... :)

OH...we also used to jam with another guy who had an original song about Dorian Grey...pretty cool...!

They're doing a pretty amateur job of expunging the hundred's (thousands?) of comments left there. Funny thing is that LGF is blog rolled there. I wonder how long that will last.

I wish that Rick would have just come out and admitted he screwed up, maybe tossed some money Iowahawk's way and everything would have probably been forgiven. I really doubt that Iowahawk wanted blood.
But Iowahawk asked him a couple of times to either remove the material or properly attribute it. Rick just ignored him.

Now he's just covering it up.
And we all know how well that works on the Internet.

I got lucky, I had a bunch of great profs at the Community College Level.
A bunch a math profs that sorted me out in that area, I'm truly hopeless in math. With their foundation I made it through Linear Algebra and Vector Analyses.
A Biology Prof. who taught how to analysis not just repeat what he said.
A Chemistry prof who made his class a blast, both literally and figuratively.
A that English prof.

Without them, and the foundation they laid, I wouldn't have gotten a B.S.

You always - if you're a foundation - have a trust account. Your investment manager gets a fee, he doesn't hold your money!

But - I speak as a denizen of nonprofit world - one does not, ever, place one's assets in the hands of an investment advisor. One has a trust account, and pay a fee to an advisor, who has authority to buy and sell, but not to actually touch the endowment.

It simply is not done.

Bastards had me clicking all over looking for Iowahawk! BTW I tuned into Fox News and got Rick Warren. When I taught Hostage Behavior at the prison I would bring up the story of the woman who got her hostage taker to give up by serving him pancakes and talking about the book The Purpose-Driven Life. The point I was trying to impress on my students was "try and improve your situation", if the hostage taker has kids talk about your kids. If he is a Cowboys fan talk up the Cowboys. (This is where Redskins fans say they would rather die.) Anyway she got away by convincing him to give himself up. I later learned that she also shared her meth with the perp. Still, whatever works, as long as lives are saved.

hey all lizards online xmas eve, how about a little plumbing emergency! I'm down visiting Mom, who had the plumber out for the fifth time in a month to look at the kitchen sink, and said we should just leave it open for a week, spilling water onto the walkway along the side of the house.

Well, guess what, it's not just the kitchen, it's the main. And the regular plumber can't even handle that, he tells us to call Roto-Rooter - who will come out right now, at premium. But, well, it seems it's still flowing at 10% or so, so if we're careful on the water, we can wait until Friday.

Idiot plumber to put us in this situation.

Um, anyone have any particular advice, for this situation?

The Journal report comes on the same day that the Times Co reported a 20 percent drop in advertising revenue in November, compared with the same period last year...

Frankly if there is that much water it's worthwhile getting it fixed ASAP and paying the freight. If you let it leak that long the water damage to other areas of the house could easily cost more than paying the premium for an ASAP fix.

This is a little complicated, but: a trust account should be held by a major institution, not an investment house. In other words, a separate, pretty much untouchable account at your bank.

To put it in an investment house is just...wrong. Not for a private individual, but for a foundation.

Foundations are - or are supposed to be - perpetual trusts. A board exists to serve the money in the trust, not vice-versa.

Well, most foundations that I'm acquainted with use a major bank. Out here on the West Coast, that would be BofA, Wells Fargo, or someone like that. A Trust Agreement is signed, and that means that, while the bank will receive a fee, and any interest, dividends or principal payments will go through the cash accounts, they merely record and track holdings - in this era of electronic records, that means that the holdings are recorded by them, though it used to mean that they held the actual paper certificates. These days, those certificates are "held" by a central repository, and I have deep and unhappy doubts about that situation. But, and this is important, the bank has no control over the assets. That's why it's a trust.

Individuals can have trust accounts. But I know absolutely nothing about that side, as (pretty obviously) I don't have that kind of money.

The point is, no foundation should leave its assets where they can disappear into thin air: that is, one does not - ever - leave the assets in the hands of the investment advisor.

Yes, the main sewer to the city street. No water leaking anywhere, as long as I keep the plug in the 2" access, but it seems any running water in the house or garage, backs up - and apparently, slowly drains.

Holiday Inn up the street has rooms for $99, if need be, but elderly Mom is disinclined. My brother and son were going to stay over, we redirected him for this night, since he was going to arrive late anyway.

Why does this always happen on only the worst night of the year?

And just how stupid was this regular plumber?

That occurs to me, too, and I dunno either. Regular plumber is an idiot, not worth going to court for. We could probably afford the premium without too much fuss, but it doesn't seem a crisis, as long as we keep the flushes to a minimum. So far. Sounds like the drain pipe from the house to the main sewer is plugged. Gotta get Roto Rooter. The plug is probably within 100 feet of the house. Tree roots have a way of invading drain pipes and then "stuff" starts to dam up.

I'm done. I didn't wrap his Satellite, just placed it on the desk. He's gonna' be floored! I grated some of the carrots and chopped up a few to simulate chewed-up bits, ate the cookies and drank most of the milk.

Um, are y'all sure that if it gets worse it can be fixed by Roto Rooter - even at a premium?
FWLIW, I'd be calling Roto Rooter now myself; in this kind of weather you can never tell how bad bad can get. Just saying...

where is she?...is it freezing?...where is the water coming from?...are there any spaceships nearby?..RR is a drain outfit..why is water just running out the house?...I dont get it

FWLIW, I'd be calling Roto Rooter now myself; in this kind of weather you can never tell how bad bad can get. Just saying...

While I was foing care taking work, we used Roto Rotter on 90% of our plumbing emergencies. One thing about Roto, Rooter, is when they fixed something, it stayed fixed.

Sounds like the drain pipe from the house to the main sewer is plugged. Gotta get Roto Rooter. The plug is probably within 100 feet of the house. Tree roots have a way of invading drain pipes and then "stuff" starts to dam up.

maybe but that usually doesnt happen sudden like...and that's way below ground

See the topic of the thread was how Iowahawk had been plagerized, so I read Iowahawks piece and didn't see Biden mentioned so assumed that when JCM said "Biden has a history" he wasn't talking about plagerizm.

Are they pricey, should I worry that I'm not getting a couple of bids? Seems like half our local yellow pages is full-page plumbing ads.

That's probably it.

Now, Mom says there's a cleanout plug burried at the back of the house. Burried!?!? A little poking in the dark, hasn't uncovered it. I guess we just tell the plumber, and hope they can find it. Wish I was in better shape or more of a do-it-yourselfer.

"shoot yer sink" sounds like good advice, too.
