26 lawhawk  Nov 24, 2014 6:17:47pm

Ferguson had national guard and state of emergency as a result of a cop killing an unarmed black man and the likelihood of a failure to return an indictment.

Yet, no one was going to hold the Bundy Ranch extremists responsible for taking aim on federal law enforcement. No state of emergency. Nothing.

And here we go with McCullough’s statements are on… as is his obfuscation about what happened in the days after the shooting and the improper evidence gathering and failures of policy and procedures - to simply claim that that was not the case.

The fix was always in, and had McCullough truly wanted an indictment, he could have presented the evidence accordingly. He chose not to.

This is on him, no matter how much he thinks he could pawn it off on the GJ.

It was his prosecutors who presented the case to the GJ. It was his office who framed the case, provided the context, and the order of the case.

re: #142 Justanotherhuman

This is why grand juries are so hated.

If this prosecutor had any balls at all, he’d go ahead and charge Wilson.

It’s not balls he lacks, it’s a fucking conscience, an understanding of right and wrong. When this man looks at a picture of Michael Brown, he doesn’t see a young man cut down in the prime of his life. He sees another of “them,” a black man just like the one that killed his father, and figures that if a cop says he had no choice but to shoot, then he’s telling the truth.

McCullough wasn’t in this to see justice done. He was in this to protect his own.

The grand jury was composed of 12 people “selected at random from a fair cross-section of the citizens,” according to Missouri law. The jurors, whose identities were kept secret, were 75 percent white: six white men, three white women, two black women and one black man. St. Louis County overall is 70 percent white, but about two-thirds of Ferguson’s residents are black.

So, maybe 8 to 4? 7 to 5? (voted to NOT indict).

So McCullough just saved Wilson the cost of hiring a defense attorney by running all the evidence, even the exculpatory evidence, by the grand jury. That way, when people say that Wilson was never actually put on trial, his defenders can say “Everything was presented to the grand jury and they saw no reason to charge him!”

Hey, wanna know more about this prosecutor?

In the early 90s, McCulloch prosecuted Axl Rose of the band Guns N’ Roses for charges related to the Riverport Riot.[2]

In 1997, in the so-called “Kinkogate” case, McCulloch gave - using the power of the grand jury, but without informing it - a subpoena to the police in order to identify a whistleblower who was acting lawfully. He pretendend his fax contained a threat. McCulloch later admitted that there was no threat and no crime, but denied any wrongdoing. The whistleblower had to quit his job.[3]

In 2000, in the so-called “Jack in the box” case, two undercover officers shot and killed two unarmed black men. In 2001, they told a grand jury that the suspects tried to escape arrest and then drove toward them; the jury declined to indict.[2][4] McCulloch told the public that every witness had testified to confirm this version, but journalists reviewed the previously secret grand jury tapes and found that McCulloch lied: only three of 13 officers testified that the car was moving forward.[3] A subsequent federal investigation found that men were unarmed and that their car had not moved forward when the officers fired 21 shots; nevertheless, it decided that the shooting was justified.[2][4] McCulloch also drew controversy when he said of the victims: “These guys were bums.”[2]

251 Justanotherhuman  Nov 24, 2014 7:03:45pm

Trashy yokel? The grand jury did a lot of work. When you announce a decision, you owe it to the people some accounting of why. And that’s what he did. He explained how they arrived at their decision, how the witness statements were compared to the physical evidence, etc.

Crude invective is trashy. Careful accounting of what the grand jury did before arriving at its decision is not.

McCulloch, erred big time when he said ‘The duty of the grand jury is to separate fact from fiction.’ It is not the Grand Juries job to determine ‘fact from fiction’, only to determine probable cause, not who is telling the truth.
The racial makeup of the jury did not reflect the ‘local community’, only the ‘county’…That can be pursued at the Federal level.
