Ninth Circuit Denies Center for Medical Progress’s Appeal - Discovery Must Proceed

A win for the good guys

Bad news for anti-choice extremist David Daleiden and his Orwellian “Center for Medical Progress” today. Their appeal to the Ninth Circuit Court asking for the National Abortion Federation’s discovery process to be blocked has been denied, and they’ve been ordered to turn over the names of all the people with whom they shared the NAF’s confidential information, including the deceptively edited “sting” videos at the heart of the Republican Party’s recent Planned Parenthood witch hunts.

CMP has thus far refused to identify those individuals despite repeatedly being ordered to do so by the district court, claiming they had a First Amendment “right of association” to refuse to disclose these individuals because they were “donors” and “critical supporters” of CMP’s “activities.”  The Ninth Circuit squarely rejected these arguments, and held that the individuals in question were “intimately involved in the planning and funding of the Center’s alleged conspiracy.”

This is the second time in two months that CMP and David Daleiden have attempted to shut down discovery that the district court held is “essential” to our pending preliminary injunction motion.  The district court has described CMP and David Daleiden’s conduct in litigation as a “shell game” and an effort on their part to “hide the ball.”

“Every day that the defendants refuse to disclose who they gave access to our confidential information puts our members in harm’s way,” said NAF President and CEO Vicki Saporta. “Given the recent attack at one of the Planned Parenthood affiliates who was featured in the defendants’ discredited videos, it is more important than ever to protect the safety and security of our members.”

Since July, NAF has been seeking a preliminary injunction, which would prohibit CMP, David Daleiden, and others from releasing recordings and materials they illegally obtained at NAF’s educational meetings. The preliminary injunction hearing is now scheduled for December 18.

This is also bad news for horrible right wing troll Chuck C. Johnson, because the NAF is currently seeking to depose him to find out who supplied him with the CMP’s videos, and recent filings make it clear they strongly suspect Johnson and Daleiden directly conspired together.

Well his buddy Ziimmerman stole an image from one of the stock photo sites, ran it through a couple of Photoshop filters, put his name on it, and sold it for $100,000 on ebay. You can see why these two get along so well, except CCJ still hasn’t figured out how to make any money from what he steals.

His site uses WordPress and there are watermarking plugins that can be configured to let you manually choose which images to watermark, automatically watermark all images upon upload to the Media Library, watermark only images of a certain size upon upload, etc. My guess would be that he probably doesn’t have a clue about the inner workings of WordPress or how to change the plugin’s configuration.

You didn’t grow up on a farm walking out the back door to go small game hunting for my example. They’re just tools like anything else but they are the only tool that will do for certain things; hunting & the military come to mind.

That doesn’t account for many others though. That’s pretty much smack in the lap of the racist propaganda from the NRA - which is actually consistent throughout it’s history. It’s just that in the old days they called for the blacks, irish, italians and other urban undesirables to be not allowed to own firearms and tried to have handguns put in the NFA. So there is this new ISIS video with an ISIS thug (who looks somewhat Slavic to me, though he seems to speak Russian with a bit of accent) cutting the throat of a Chechen guy, allegedly an FSB agent. This is the first ISIS video that I’ve seen, and the subject matter aside, I’m shocked at how high the “production values” are. These are not your grandfather’s terrorists’ grainy videotapes…

You know, I really get tired of the “both sides are the same” rhetoric.

The terrorised Left protests with votes and letters to Congress. The terrorised right protests with weapons.

Many in the media are making hay out of the shooters in San Bernardino being Muslims (thus are automatically terrorists, because terrorists are always Muslims, natch). Can’t be anything else, no sir.

Meanwhile, the shooting in Colorado Springs at Planned Parenthood exactly fits the definition of domestic terrorism according to the FBI’s description, and the House Homeland Security Committee says “no it’s not.”

No, the left and the right are not the same, and the libertarian (and Republican) claims that they are are really FUD.

There was recently a lengthy article featuring interviews with ex-ISIS personnel from the propaganda wing. One guy said that sometimes it took the better part of a day to do beheadings because they had to carefully set up different camera angles and take several “before” takes as the executioner read off of a cue card. I’m sorry; I don’t remember where I read that.

The terrorized right has responded by making Donald fucking Trump the front runner in the GOP presidential primary. And being on board with selective application of the first amendment. And thinking requiring registration of Muslims or mass deportations (including apparently citizens) is acceptable. And they are doing that with votes - which is why we have Ted Cruz.

And if Mr. Trump were elected, I can foresee the terrorising that would follow.

The local newspaper here (very conservative leaning) printed a letter from me today. (Since everyone in the county knows me and everyone in town gets the newspaper, I suspect I will hear about it - though our village clerk already gave me a thumbs up this afternoon.)

Will Governor Ricketts seek to ban Coloradans from Nebraska (the way he is trying to do it with Syrian refugees)? After all, there might be terrorists embedded amongst them, and “we can’t vet them all sufficiently.”

There have been three terrorist attacks in Colorado this year: Arson at the NAACP (Jan 6), arson at Planned Parenthood (Sept. 30), shooting at Planned Parenthood (Nov. 27). There have been no attacks by Syrian refugees in Colorado this year.

What I can see is terrorising Syrian refugees from the right. I do not think folk on the left would do that.

I wrote a letter to my state governor (and pointed out as an atheist I understand the call in the New Testament to help the least of these better than he allegedly does). He responded with the usual “I have to keep Nebraskans safe,” which prompted my letter to the paper.
