It would indeed have been troubling if they had done this. However, as in all legal-related matters there are going to be arguments on both sides in that hyper-nuanced world.
I think it’s to the credit of the Bush administration that they ultimately decided against this policy despite vocal arguments in favor of it from multiple advisors, including the supposedly all-powerful “man behind the curtain” (if you believe the moonbat conspiracy honks) Dick Cheney. Clearly W. kept his head screwed on straight making the call on this.
Having frank discussions among Presidential advisors with strong advocacy on both sides is crucial for giving the President the most and best information on which to base his decisions. A bunch of yes-men all thinking inside the same echo chamber (as Barry Zero seems to have) never allows one to challenge his initial knee jerk reaction.

They talked about it, and the President decided NOT to proceed. What’s the issue?
I wish we could say the same thing about much of what Obama does now.

You are both missing the point that if this story is true, half of the president’s team were the sort to even think this was a good idea. This is not something to just brush under the rug.

If an Obama advisor even breathed a word like this, blogs like LGF would be on fire. The hypocrisy here astonishes me. Am I to take away from this, that the Constitution only gets applied to Obama, but if Bush’s team, breaks it - and what about warrantless wiretaps - it is ok?

No, you do not get to make apologetics for this. If this is true, then what we are talking about is no more or less than a large number of the past administration proving how little they like American law or institutions by reaching a new low. Now I truly hope that this article is exagerated, but I will not tolerate a “It’s not fascism if we do it” line.

Oh please. Obama himself derides the Second Amendment at least every other week. He criticized Bush for Executive Signing Memos on statutes, and does it so much himself that his own party criticizes him for the practice. So, it isn’t just “talking about it”, Obama, his AG and others in his Administration actually do unconstitutional things. Don’t even get me started on the contract clause and what has been done in the name of ‘stimulus’. The hypocrisy is in raising a DISCUSSION the last administration had and getting your knickers in a knot over it. At least Bush said no.

Pause a moment and analyze what you just said.

1. Whatever O does or doesn’t do has no bearing on this. Either this happened or it didn’t.

2. I am not aware of any issues with the Dems shouting about signing statements, however even if what you claim is true, and I am not saying it is, and O made one and some Democrat were upset about it, W. used signing statements like no other president. But of course, that would have nothing to do with this either.

3. The point is that we have seen comment after comment here deriding this or that minor advisor here. This one is going to convince the president to take away your meat because he’s a radical vegetarian, that one is into population control, yadda yadda yadda. Yet here we have A MAJOR PORTION OF KEY PLAYERS in the last administration actually talking like police state fascists. Do you see the point?

I said upfront, first that I hope that this story is exaggerated and two, that to be fair, the suspects were arrested by the FBI and not the Army. This does not change the facts about what sort of culture the last administration had. Further, if this story is true, that culture was worse then many thought.
