Fixed it ... apparently CBS found another way to confuse my video embedding parser. I know what it is. Part of the attributes need to be removed.

The "voters" used to stop interracial marriages too. And if you were to take a "vote" 600 years ago, everyone would have said the Earth revolved around the sun. Human rights (to me) are as much a fact as science, and shouldn't be subject to popular will.

I think a big question with this ruling is what "harm" to heterosexual marriages means. If harm means changing ideas about the ideal straight marriage, then you could argue that gay marriage does harm. On the other hand, if harm has to be purely economic, your case would be less solid. One thing is clear, though: defining "harm" means a moral judgment. The idea of being able to get away from personal morality is an illusion. We're just deciding between one kind of morality and another.

For those who want to learn about how important the 14th amendment is to our country in a very entertaining manner, I recommend Jeffrey Deaver's crime Novel - "The Twelfth Card" -- it's one of the better books from the Lincoln Rhyme (the quadraplegic detective from "The Bone Collector") series.

re: #5 'K.'

What do you think it means? If the harm is nothing that is measurable, then there's no harm.

If you think that ending ideas like kids doing better with both biological parents or marriage having typical gender roles produces "harm," then certainly gay marriage has a measurable effect. If on the other hand you think these ideas are bad and need to go, there's nothing to even try measuring. Both views are subjective.

Though the biological parenting issue does have some objective parts (as in, the kids' achievement level, abuse rates, etc). Gender roles, though, is pretty subjective.

Brain fade oops? The Earth does revolve around the sun.

Have to disagree about the need to go back 600 years. The relentless attack on public education has been far too effective. Expect the nationwide ballot question "Does the Sun and the entire Universe revolve around the Earth?" would get a majority yes vote today, especially if asked during a relatively low turnout election such as an off year primary.

K everything is subjective. We make laws and base our reality on an agreement of subjective reality. Yes everything is subjective but I don't think you are going to win a 10 million dollar court case because someone called your little billy a "booger face" in kindergarten, no matter how much your reality screams "HARM".

The Constitution is the highest level of our agreement on subjective reality. The courts decide what harm is and they've made their call. We aren't substituting one reality for another, that's what the bigots are trying to do when they discriminate and segregate.
