Santa Fe : Gay Marriage Legal in New Mexico, Clerks May Now Issue Marriage Licenses
Neither New Mexico’s constitution nor its statutes have ever forbade same-sex marriage, there exist only statutes which forbid a list of certain kinds of marriages, and same-sex marriage is not on any of those lists. New Mexico is quite possibly the only state in the union to have never addressed the issue. Thus today, the mayor and city attorney of Santa Fe have declared same-sex marriage as lawful and have instructed the municipal and county clerks to begin issuing marriage licenses for same-sex couples seeking them.
