To me this is like arguing over the massacres in Rwanda, Bosnia, and finally Darfur. To be debating liability more than 10 years after the event is pretty pointless. 20 years after the event anyone involved has grown up .. had a set of kids .. married twice .. divorced once .. and moved on.

The argument over intrinsic liability is something best fought over in a text book. Outside of that it now belongs to history.
