Not necessarily. It would depend upon exactly what the court chose to uphold. For example, the 9th Circuit’s decision was very narrowly crafted. They explicitly stated that their ruling applied only to California. It’s quite possible that the Supreme Court could strike down Prop. 8 on the the narrow grounds that it removed a right that was already being exercised, without ever making a more general decision that banning gay marriage violates the equal protection clause. A number of legal scholars are recommending that the court do just that.
