Ah, I see you’re positing the theory of Quantum-Jurisprudence, where all people are simultaneously innocent and guilty of everything until a jury observes them and by observation forces them from their judgmental super-position.

That’s easily accomodated by punishing individuals randomly for the crimes they will inevitably commit.
