Its not illegal until you are convicted. That is the exact statement my pro-Romney co-worker said today when I pointed out how Mitt absolutely cheated one way or another to acquire $100 million in his IRA.

If it’s an illegal act of tax sheltering it would fit under that category. But legal tax sheltering is simply not tax evasion. The IRA we can’t prove anything for or against since we have no proof otherwise. So right now saying that Mitt Romney “cheated” is a negative which can’t be proven or unproven.
