In my job there are no such thing as traffic accidents. We call them crashes. Accident implies no fault or root cause. Crashes have a fault or cause, usually human operator but occasionally systemic such as a poorly designed intersection. Guns should be treated the same way. Negligent discharges instead of accident discharges. Someone did something wrong and the gun went bang. As Dangerman says, hold that person liable for it.

I don’t see a need to even have the concept of negligent discharge of a firearm in the law. Guns are deadly weapons, therefore negligence is not a permissible concept. In cases where the shooter is clearly not responsible (e.g. a toddler), charge the responsible adult as if that adult had done the shooting.
