Hey, posken for me a bit. First we both know that the Written Law doesn’t prohibit lesbian sex.

As for sex between men. Do you think that it is implicit that the Law was telling them to hit the road - go someplace else - and not stay in the community?

Ohhh poskining is well above my pay grade. I am not a rabbi. I do have some yeshiva, but honestly I could not in good conscious say that is the view of the Orthodox community.

That is actually a question that I can not give anything other than my own opinion on.

As to facts of the law, it is certain that women are very specifically treated as a different case under Talmudic law then gay men. Specifically Lesbian sex is not defined as something that incurs a death penalty.

It is also true that the medieval commentators expanded the rulings on gay men to gay women. However, they have a hard time agreeing on just what lesbian acts mirror the male acts in a formal sense.

All that said,

There is a strong halachic argument that if they can not choose these acts, but instead it is their nature, that the previous rulings do not apply in the same way in that it creates a separate case.

Not everyone agrees with that argument.
