It’s a piece of evidence, but that’s that. Save for an unlikely confession, the only thing they have is that he was advised to not pursue by the cops, as Gus points out. But they won’t prove he shot with intent to murder. And, strictly speaking, we don’t know that he actually wanted to murder him. That’s not the point. The point is that at the very least he should answer heavily for criminal negligence/manslaughter (and negligence seems to be excluded by the above quote).

Multiple callers to 911 report that someone (and most indicated that it was the voice of a man) was yelling “Help! Help!” shortly before the gunshot. That’s the sort of evidence that no one is going to able to spin much, I think. (I’m assuming it was Trayvon Martin that was screaming for help.)
