The court bears a degree of responsibility for giving the child to this stranger. The killer is not a legal stranger but, the child did not know this man who ended up torturing him for a month.

This is too screwy for words. Why did the judge do that? Because the biological father sued, I suspect. I agree with you: the court has a responsibility to do due diligence in cases like this. I can’t help but wonder if the custodial grandmother put up a fuss, or whether she was just glad to be rid of the kid.
