Marshall I read was none too happy when he found out who his successor was. Anyhow, him and Bill Brennan, two of my favorite modern justices. My problem with Thomas as a justice is he exhibits none of the intellectual curiously and passion for the law you want out of a justice. I’ve told this story before but I’ve got a law school friend who’s a liberal who tells me she respects Scalia much more than Thomas for this fact alone.
I’m no expert on this, but i think that Thomas has a pretty consistent philosophy. Sadly, it involves rolling back society to the 1840’s.
But it has lead him to some surprising conclusions, like the one a few years ago when he stated that he could not imagine the founding fathers having any law against the growing, possession, or smoking of pot.
Scalia is just a political hack. His sarcasm and pugnacious stances are no substitute for reason, and his reputation as an intellectual is founded on the same idiotic view that Newt’s is.
