It is not defined, actually, and thus there have been some on the right who have suggested that a Republican administration and Congress should just get rid of all the associate justices on the court by abolishing their positions, only to recreate those positions the next day held by different people. I don’t like the idea, though, since its would turn the Supreme court much more political than it is now.

We already had enough trouble over the keeping or firing of the previous admins appointees with every new presidency, we don’t also need controversy over the “changing of the guard” at the SCOTUS as well.
