Well considering states rights were used to justify slavery and later segregation and bans on inter-racial marriages, your nauseousness is not without reason. I mean I know it sounds contradictory but I really think there are certain things that the states shouldn’t be able to decide because certain things like equality are something that a state shouldn’t have the right to limit. Same thing with the Feds too.That’s why I proposed constitutional amendment on gay marriage bothers me. We’d be amending the Constitution to limit freedom. And honestly outside of Prohibition, we have never codified taking away a right into the Constitution. Now, we have many a time used the Constitution to grant people rights which is another reason why I’d support an amendment allowing gay marriage.

States’ Rights is the battle cry of people who haven’t actually read the whole Constitution — they don’t seem to realize that the 14th explicitly limits the scope of the 10th.
