True, but that requires that the foreign country in question be considered an adversary.

Biden and likely his Justice Department will unquestionably feel that way, but at the time it was done most people would tend to feel that Russia was an ally of the government at the time.

If I were her attorney I might try arguing in front of the jury that she can’t be up for Death Row because in order to accept that she was selling to an enemy, you have to act as though the current government was already the government in question on 6 January.

And if we do that, the next Republican administration will charge anyone who continues dealing cleanly with the outgoing administration’s allies-that-won’t-remain-such-under-the-GOP. It’s not like Trump didn’t want to charge Obama himself for not immediately pivoting the country’s alignment towards Russia on November 5th, 2016 already.
