As I understand it, in Germany, the speech codes relate to the Constitution of Germany which has a fundamental concept, the dignity of the person (and the dignity of the person has to be upheld)…(In France, there are more explicit laws against “hate speech”…but, again, as you’ve noted, that doesn’t really hamper people from expressing themselves..)
