It doesn’t matter. It was improper. This is common sense.
They are both lawyers and should understand the legal concept of avoiding the appearance of impropriety.

I would think lawyers would also understand that the appearance of impropriety is enhanced by taking action that only makes sense if one engaged in an improper act. Recusing herself will not magically erase the conversation, it will instead fuel speculation that the two were engaged in discussion of the case and how Mrs. Clinton might avoid indictment and/or a felony conviction.
