I actually would almost be tempted to have a national referendum on same sex marriage just to show these people how wrong they are but I really don’t feel civil rights should be up for a vote and if they lost that referendum, you’d know they would still be bitching. The court made its decision on SSM. They lost. They need to deal with the fact that gays can marry everywhere in this country now.

Ultimately, civil rights are always determined by a vote, one way or another. Marriage equality was settled (for now) by a 5-4 vote of the supreme court justices.

A popular vote is usually worse than judicial decisions for protecting civil rights, but a RWNJ supreme court would be worse than anything. If we add one more RWNJ justice to the existing wingnut block, every SCOTUS decision since Brown that expanded civil rights would be likely to be overturned, and Brown itself might come under attack.
