I think Posner would be the oldest first year USSC justice ever if picked. You’re right though. I’d get a big get out of them trying to reject a Reagan judge. I think the best time to have done that would have been if there had been a vacancy in the mid 90’s following the GOP takeover of the Senate in ‘94.
I was in law school during the height of the Bush Administration. There were more than a few people who thought Kazenski or Posner would have been on Bush’s short list. And then Harriet Miers happened.
