The 9th covers a huge geographical area: Hawaii, Alaska, Washington, Oregon, and California. Splitting it could leave California in its own circuit and the other states being in a new circuit. All would start off having adopted the 9th precedent, and they can diverge over time.
Okay, that works, except it leaves the state with a larger population to serve than any of the others. Do all the circuits need to have the same number of judges?
