WKA simply does not pertain to children of citizens born overseas though. Cruz’s NBC status is based on the Naturalization Act.

I will agree that WKA isn’t binding because WKA was born in the US and the opinion doesn’t actually rule on a person born overseas. The opinion does, however, discuss the entire subject so its convincing. Justice Gray would say that the fact that the citizenship of a child born overseas to American parents depends on an act passed by Congress pursuant to its naturalization powers demonstrates the child is not natural born.
