re: #27 Love-Child of Cassandra and Sisyphus

Roe v. Wade was a legal decision. Because our legal system usually respects precedent, no lower court was going to reverse it.

States have been trying to get around it, but they can’t attack the idea of abortion as a right, directly. So various schemes have been devised to attack the service providers and helpers, etc.

What TX did was make it impossible for anyone to get an abortion after 6 weeks because TX is making it illegal for anyone to help anyone get such a procedure, and furthermore offering money to anyone who identifies anyone who helps anyone get an abortion.

It’s all very contorted, but here we are.

“Contorted” is a good word. “Machiavellian” is a good word. “Rube Goldberg Legal Device” are good words.

No-one in Texas wrote this law. It was just the first state to introduce it. Other States, like Mississippi, are trying to freeze abortion at fifteen weeks, making viability possible at that point because hummina hummina gazpacho no reason whatsoever we’re throwing that number out there because whatever.

Texas, at six weeks, doesn’t even *mention* abortion or Roe. It just says that a heart beat is evidence of human life (it isn’t). We have, since human organ transplants began, a pretty good definition of human death. A working forebrain. Brain death = human death.

This was important because we didn’t want to be vivisectionists. But if that’s a definition of death, it should also be a definition of life. In other words if the there is no working forebrain then there is not a human life.

This makes perfect sense, and should be established in law.

At six weeks, the little “baby” is smaller than kidney bean, has no real brain or circulatory system, no bones, a tail, and is no more human than a reptile. It still hasn’t grown the vestiges of a mammal brain.

A fetus becomes an embryo at eight/nine weeks and is *potentially* a human life, but until it can survive outside the womb, it cannot be a viable human. It’s just a dead baby that got born too early.

Acorns are not mighty oaks. Eggs are not chickens.

The technical definition of “miscarriage” is “spontaneous abortion”. It happens a lot.

Over 40% of zygotes, maybe up to 50%, are flushed out of the uterus without implanting or rejected by the uterus in the first three months.

The uterus does this for a reason. It is not purposefully murdering children.

But we are entering a new world where a woman’s uterus is a political football. “You’re murdering uterus has had two miscarriages! We are charging you with manslaughter!”

Brave New World.
