Actually, it may be a worthwhile tactic for ACORN. First off, they somewhat misstate their case: it isn’t illegal to make such recordings, but without prior consent from both parties they are inadmissible as evidence in a court of law. The most likely explanation, then, is the suit being a preemptive move to exclude the videos from use in any future actions that may be taken against ACORN resulting from their contents. They’re likely pumping poison into the evidentiary tree in order to taint any fruit it might bear later.
