ACORN is probably hoping to force a settlement. A trial would not be in their interest. They'd likely have a hard time finding a jury that would find in their favor and facing a discovery process could bring even more skeletons out of their closet.

The liberal group contends that the audio portion of the video was obtained illegally because Maryland requires two-party consent to create sound recordings.
The two employees seen in the video were fired after it was posted online. The lawsuit says the employees, Tonja Thompson and Shera Williams, suffered "extreme emotional distress."

Well...OK. I wouldn't consider it 'news' or anything, but I noticed a curious trend when I was looking around online for job openings with the railways that were oriented towards the conductor or engineer positions.
For a good deal of them, there seems to be this curious geographic pattern. I went and looked up the towns these positions seemed to be based out of. Between the three or four companies that were hiring (two of them being outfits that operate several disconnected short-haul or reigonal railways), there seems to be a string of job openings from the Sabine River (forms the southern boundary of the Texas/Louisiana state line) up into the Ozarks on both the Arkansas and Oklahoma side and then on to some of the towns south of Kansas City on each side of the Kansas/Missouri state lines.
Would the fact that all six states these job openings were posted in have unemployment rates well below the national average? (Closest one being Missouri at 9.5%). Of course, the upcoming harvest season might be why some of these railways need extra crews, but not all of them.

There's a lot more problems than that about any attempts to prosecute ACORN. Check this out:
Riding the crest of the media frenzy surrounding the ACORN revelations, Republican legislators pushed for the more punitive outcome: mustering broad support for passage of a law aimed at cutting ACORN's funding - a paltry $53 million over the past 15 years - based on the misconduct of a small group of employees.
The problem is, in enacting a law that makes it possible to hold a group like ACORN responsible for the actions of its employees, the GOP might have opened up Pandora's box. Consider, for example, some other groups that receive government funds (far in excess of $53 million over 15 years) whose employees have committed far more grievous crimes (ie, rape and murder for employees of KBR, Blackwater and other private contractors). Ryan Grim on some of the implications:
Going after ACORN may be like shooting fish in a barrel lately -- but jumpy lawmakers used a bazooka to do it last week and may have blown up some of their longtime allies in the process.
The congressional legislation intended to defund ACORN, passed with broad bipartisan support, is written so broadly that it applies to "any organization" that has been charged with breaking federal or state election laws, lobbying disclosure laws, campaign finance laws or filing fraudulent paperwork with any federal or state agency. It also applies to any of the employees, contractors or other folks affiliated with a group charged with any of those things.
In other words, the bill could plausibly defund the entire military-industrial complex. Whoops.
Rep. Alan Grayson (D-Fla.) picked up on the legislative overreach and asked the Project on Government Oversight (POGO) to sift through its database to find which contractors might be caught in the ACORN net.
Lockheed Martin and Northrop Grumman both popped up quickly, with 20 fraud cases between them, and the longer list is a Who's Who of weapons manufacturers and defense contractors.

Actually, it may be a worthwhile tactic for ACORN. First off, they somewhat misstate their case: it isn't illegal to make such recordings, but without prior consent from both parties they are inadmissible as evidence in a court of law. The most likely explanation, then, is the suit being a preemptive move to exclude the videos from use in any future actions that may be taken against ACORN resulting from their contents. They're likely pumping poison into the evidentiary tree in order to taint any fruit it might bear later.

Fenway, I'll believe it when I see it man. It's been rumored to be his last year for like, 5 years now. Although he's had some issues with our new GM Frank Wren.
I've got conflicted feelings though. Part of me is so loyal, but part of me feels like the game has sort of passed him by. His managerial decisions are leaving a lot to be desired. Poor bullpen management being the most troubling.
Side note;
In order for the Braves to miracle their way into the playoffs, they have to go 8-2 the rest of the way and the Rockies have to go 3-7.
We play Washington, Florida, and Washington. They play SD tomorrow, then STL, MIL, and the Dodgers.
Not gonna happen but until they're officially eliminated, my mind will not rest.

Depends. Other states have similar laws. It would certainly have an impact on any investigations in Maryland, eliminating, what? 20% of the potential cases? With other tapes already drifting into the "Questionable" category, that alone is a good outcome.

Hefeweizens are wheat beers...they use wheat for at least 50% of the base malt...before prohibition most beer in the US way brewed w/wheat. Ocktos are seasonal brews as are Marzens...pretty much the same thing...they use a specialty malt called melanoidan.

Phillips' account sounds exactly like those of the two people I've known, and accords with all other accounts of which I am aware about this phenomena. The two situations I know of involve children reunited with a parent as an adult. One was male; he was 18 and his birth mother was about 36 when they met. The other was female; her father had divorced her mother and she hadn't seen him from the time she was 8 until she was about 19.
In both cases the parent was the one who pursued the sexual relationship, talked about running away together (just as Phillips says her father did with her) and having children together. In both cases the parent tried to control who their child might meet and have a normal happy relationship with-- although in both cases the parent was married again to someone.
That's why the detail Phillips relates about her father initiating the sexual relationship (by means of rape) the night before she was to get married rings especially true to me. In both cases I personally know, that is essentially what happened: the 'parent' provided alcohol to the underage child.
There is also a name for this, Genetic Sexual Attraction. If you aren't raised with a sibling and meet them as an adult, the incest taboo doesn't kick in the way it does normally. On a charitable reading, that's what happened in the cases I mentioned.

"One, the 'Ancestral North Indians', is genetically close to Middle Easterners, Central Asians, and Europeans, whereas the other, the 'Ancestral South Indians', is as distinct from ancestral north Indians and East Asians as they are from each other," they wrote.

N.D. men charged in connection with alleged attempted kidnapping of 14-year-old
Two Fargo, N.D., men were arrested Monday on attempted kidnapping charges after allegedly traveling to Bowling Green to take a 14-year-old girl back with them to their state.
Dragan Jovanovic, 42, 830 Countryside Park, and Elvis Tahirovic, 18, 847 Countryside Park, were charged at 11:42 a.m. Monday with attempted kidnapping of a minor by the Bowling Green Police Department.
According to Officer Barry Pruitt, BGPD spokesman, Jovanovic, Tahirovic and two juveniles identified in a city police report as Jovanovic’s children had driven 15 hours from North Dakota to Henry Moss Middle School, where the 14-year-old is a student.
Pruitt said the girl had been in contact with the North Dakota men through a social networking Web site and had planned to leave with them and live with Jovanovic’s 14-year-old son as either his girlfriend or wife.
According to a police report, the group went to MMS on Monday and asked school personnel the times when school buses would arrive at the school, left the school grounds and returned moments later and attempted to sign out the 14-year-old.
MMS principal Thomas Renick questioned the men and learned they were not related to the student and had not received permission from her parents to sign her out of school, according to the report.
The student was not in school Monday and was at her parents’ house, Pruitt said.
Renick notified police and officers found a blue Audi containing Jovanovic and Tahirovic parked outside Dollar General, 2556 Russellville Road, across the street from the school.
Both men are in Warren County Regional Jail under a $50,000 bond.

I almost got 'skunked' last night.
Spent the entire evening potting up baby African violets--60 of them.
Went out to the compost pile at about 11:30 to dump the refuse and suddenly there was this skunk standing at attention right in front of the compost fence.
Dropped the potting tray and ran. The tray is still out there.

As for Clinton's early problems, I seem to remember that one of them was/is the same as Obama's. That being the single payer health care plan. Then it was called Hillarycare and was just as hotly disputed.

So, took the whole family to the cool ArtPrize show here in our little city last night. 30 ft. long Nessie monster in our river, an acre of hieroglyphs, a huge 12x30 ft. map of an imaginary town, a 12 ft. tall tree nymph guy walking around on stilts freaking my kids out and lots more. It's an open-voting competition with $500k in prizes. It seems the libs don't mind capitalists when they use the money to fund art or our children's hospital (even thought that's govt's job).

One of the very first things Clinton chose to handle was gays in the military. Some say this was a tactical mistake and that this was what caused him to get bogged down right from the beginning. I'm not a the closest follower of NY politics either, but I get the sense that many in NY believe Patterson is in over his head. I haven't seen polls in a while, but I at least for a while there he was pretty unpopular.

Iranian Military Planes Crashes in Annual Parade
TEHRAN - Iran's sole Simorgh AWACS aircraft was lost during a military parade Sept. 22, one of two Iranian military aircraft that crashed in Tehran while participating in a display to mark the anniversary of the start of the 1980-88 Iran-Iraq War.
The Islamic Republic of Iran Air Force operated a single Simorgh, a former Iraqi Air Force Adnan. The Adnan AWACS was in turn a modification of a Soviet-built Ilyushin Il-76 transport.
The Simorgh collided with one of the Air Force's Northrop F-5E Tiger II fighters over the area of the Imam Khomeyni Shrine, southern Tehran. According to eyewitnesses, the crash occurred immediately after the parade. Apparently, no mayday call was issued.
Both aircraft crashed in flames. Initial reports indicate that seven crewmembers were killed in the crash.

They will claim the loss of all funds as the damages, which could run in the tens of millions of dollars, but the counter-suit will be that acorn's "unclean hands" caused their own damages. I'm not a lawyer, but I can't see this going away easily. I'm guessing it'll go right up to a trial. If states start suing the pair for criminal activity under some non-consent taping laws, they'll need the protection of winning a trial.

I don't see where they're addressing the only tangible complaint against Jennings - his apparent encouragement of an affair between a high school sophmore and an adult. Not a lot of specifics, so perhaps there's less to it than there seems to be, but this sort of thing is illegal in most states, if true, and those in a position of authority - like school teachers - are required to report such incidents to the authorities in many jurisdictions. Things may have been different legally at the time, but there's still a stench emanating from this incident. It needs to be addressed. In particular, I'd like to know the ages of the student and the "older man" he was involved with at the time this occurred. I'm catching unpleasant whiffs of NAMBLA from this.

Fatah may agree to an "arrangement" with Israel that allows them additional civil administrative control, but that's what they've had since 1993 and Oslo. The Palestinians have repeatedly turned down Israeli peace deals without even the courtesy of a counter proposal, because it would mean accepting Israel's very existence as a Jewish state.
Israel still lacks a partner for peace in the Palestinians, and the rest of the ME knows this. This way, those despots and dictators can continue ginning up old hatreds to remain in power and keep the focus off their own odious actions. After all, the world shrugs its collective shoulders when Arab regimes slaughter fellow Arabs, but when Israel does anything to protect itself, the world goes into a tizzy.

Morning all! Well, I'm not sure what came over me, but I watched (and listened to the translation) all of Iran's answer to Sonny Bono's speech at the U.N. last night.
First, much as I hate to say it, good job by the U.N. folks who were controlling the cameras. They actually showed the huge number of empty seats as this maniac rambled on. I think there were more people in my living room, and I was the only one there.
The speech, however, was no laughing matter. I heard several references to the 12th imam, scattered throughout a nonsensical speech about using religion to end inequality and bring about social justice. Also several not-so-subtle references to Israel, and to the U.S.
In the end, I'm glad I watched it. It reminded me that there is evil in the world, and that there are some truly evil people with far too much power.

That's my guess. My long-shot theory: Agreement between Israel and Syria first. Which could provide psychological cover for the Palestinians to accept something along the lines of what was offered during Clinton. Theoretically, why would Syria possibly agree? (1) Questions about Iran as long-term ally. If not Iran, who? (2) Syrians much more secular than Saudis, Egyptians, etc... . (3) Syrians more interested in business than fighting losing battles with Israel (maybe an unintended result of Syria's presence in Lebanon is more interest and exposure to business. (4) Calculation that an agreement with Israel won't make or break Assad's control. Of course, whether any of these are correct, there would still be the Golan issue.

Hi Violet! I don't think he actually tossed the frog into the water (but it was on at our local watering hole and nobody was really paying attention).
But yes, it does look like he wasn't clear on the concept of "boiling the frog slowly". The idea of dropping the frog into boiling water, frog jumps out. Drop frog into cool water and bring it to a boil slowly, frog goes to sleep and ends up cooked.
As a political metaphor, it's a good thing congress and the administration brought the health care pot to a boil just a little too quickly. There's still a chance to jump out.

I don't doubt your sincerity or your compassion for the huddled masses you saw when you were there, but these are absolutely the "central issues". Of course Israel doesn't deserve a blank check any more than any other ally. What I don't think you have a full appreciation of is the incredibly anti-semitic world we live in where the Arabs are allowed to be citizens anywhere in the world (including Israel) but the Jews have huge patches of this world where they cannot even show their faces. Where Israel has won defensive wars but then was cajoled into giving those security patches of land back while getting nothing back in return. Where a false (and non-Christian) moral equivalence is drawn between killing armed men and blowing up a bus.
You mention the regular people a lot, but they are powerless there (unlike Israel). Did you meet any leaders when you were there? Did you hear any translations from the sermons in the mosques? Of course the U.S. should work for peace, not Israel but peace (shalom) is not just the state of no one shooting, but a state of security, lawfulness and justice. Whenever I mention the crimes of the Palestinians, you mention how mad Israel has made them but is it good for a society to marinate their young in hatred like they have done? What if, after the Holocaust, Israel had poisoned their kids against Germany? Written textbooks with hatred on every page? Made tv shows with ridiculous claims about Germans even 50 years later and had Rabbi's rail on them weekly and incite violence? Would they be the successful nation they are now, giving medicine, arts and technology to the world? I think these are the central issues. Can an independent Palestine live next to Israel in peace?

Anyone who studies WMD and nuclear proliferation is familiar with various concepts relating to numbers of weapons necessary to maintain a strategic balance knows that once nuclear weapons numbers dip below a tipping point, the MAD discouragement - the threat of a retaliatory strike equal or surpassing what you're about to incur - prevents a first-strike out of the blue.
When you drop below a certain point, a nation can begin to regard a nuclear war as winnable since they could conceivably take out their opponents weapons before they can launch a retaliatory strike.
Throw in the fact that regimes like Iran or North Korea may not follow MAD at all, and are following their own path (that they view as rational - in furtherance of a religious edict, cult of personality, etc.) but are irrational and don't fit into the MAD doctrine, and you have a far more destabilized situation.
You cannot put the nuclear genie back in the bottle, and attempts to disarm unilaterally will be taken as weakness to be exploited by others.

Obama is throwing missile defense out the window in re: Europe, and pushing for unilateral nuclear disarmament as a sign of "leadership" with regimes that have no such interest. Why would the Iranians give up their nuclear weapons ambitions if the US does so first? Iran has a totalitarian religious leadership, which is furthering its ideological and theological aims - and nuclear weapons would help them achieve those goals. Obama complete misses that singular point.
Then there are the nations that have regional arms races, like Pakistan and India, both of which have gone to war several times and have regular skirmishes across the Line of Control. Pakistan's weapons are not nearly as secure as anyone would hope, and yet they have enough firepower to lay waste to vast portions of India (and India has a similar capacity). If one destabilizes the numbers even a little bit, you give the nation with more weapons a significant tactical advantage, that could actually lead to a nuclear exchange - the opposite of what Obama wishes for.

It's like I've said often, quoted from Rush when he was less inflammatory: It's impossible to negotiate with someone whose sole demand is your death. Regimes like North Korea and Iran have no goal in mind but destruction of the infidel, and if we happen to send them all to Allah in return, they really don't care. This is what makes the situation so volatile, and it's a fundamental concept that many American politicians can't seem to grasp. These types of people are just plain unhinged and cannot be counted upon to respect any balance of power.

Wanting nukes gone can be a good thing. How it's done is the devil in the details that makes all the difference. If you're talking about bilateral reductions - US and Soviet, that's one thing - because at the time, the amount of overkill in the US and Soviet arsenals was incredible. Reducing intermediate range missiles and cutting down the number of ICBMs didn't completely alter the fact that both countries retained the ability to destroy the planet several times over.
What Obama is proposing is reducing our nuclear arsenals to the point where even a rogue nation could launch a first strike that could cripple the US and prevent a response - destroying deterrence, which has been a staple of US strategic thinking since the beginning of the Cold War, and which has prevented nuclear war since. As I've pointed out, once nuclear weapons numbers go below a certain point, the idea that a nuclear war is winnable becomes tantalizing, particularly to rogue regimes.

He's not tossing missile defense out, he's improving it based on recommendations from the military. The super powers can reduce there stock piles by a large percentage and still have 1000's of more war heads than the 3 world will have.
Reducing the arsenal is a goal the superpowers can meet together and still have mutually assured destruction as a deterrent.

A effective shield against a massive attack by a superpower is pipe dream, and Iran and North Korea are decades away from being a threat. To spend money now against a threat many years down the road just means we'll be using old technology meeting a potential future attack.
It's a whole lot closer than you're willing to give the scientists credit for, and if it is really the concern, why are the Russians so damned opposed to the missile defense system (which is against ICBM, not IRBM and short range tactical missile defense systems that are already operable - Patriot PAC-3). They know something you don't. Further, the missile defense system that we have now and that Obama took off the table in Europe would protect against Iranian nukes fired by missile - a bolt from the blue. Such a system would also concurrently reduce the likelihood of the need for a massive retaliation should someone get their hands on an ICBM and launch without authorization. It's an additional failsafe against limited nuclear attacks - and prevents a full-out war.
The missile defense system doesn't need to protect against a superpower-sized strike at present, only to protect against a rogue nation launch.
Iran and North Korea may be decades away from having a superpower-status nuclear arsenal, but are far closer to having sufficient weapons to make any attempt to eliminate those regimes far too costly, and can engage in nuclear blackmail at a moment's notice. The missile defense systems in the works also defuse that threat too, since they can protect against a missile launch from those rogue regimes.
Taking missile defense off the table is a huge strategic mistake, and it opens up the door for the rogue regimes to take advantage.

Sigh, where's 3wood when I need him? I don't really understand all the issues around tying a currency to a commodity (like gold or silver). I read an article recently (maybe Thomas Sowell - can't remember or I'd try to find a link). It was a response to Ron Paul supporters who support a return to the gold standard. The point of the article was (and my numbers are probably off a little, but the point's the same) that the GDP of the U.S. last year was around 12 trillion, and the total value of all the gold EVER mined is around 7 trillion, so a return to the gold standard would force an instantaneous contraction of the economy by about 60 percent - if we already owned all the gold in the world (which we don't).
So, in my really lacking understanding, my question to the smart lizards here is - wouldn't the same concept apply to any commodity of finite supply?

I wouldn't be part of the smart crown but my guess is yes. This is part of the reason Ron Paul has happy to see the economy collapse. He thinks the value of the economy is greatly exaggerated and the deflation brought the economy closer to what he thought is should be.

Yes. Any commodity of finite supply used as a base for a currency would eventually cause deflation in response to economic and population growth. As long as there is still more "out there to be mined" and the supply of the commodity increases at near the rate of economic growth then it would be ok. Obviously that will not always be the case, and the supply increases will eventually stop. With the case of gold we are way past it's usefulness as money for the whole nation or the world. Paulians are chronically stuck in 1789 on a lot of issues so this should not be a surprise.
I'm not particularly thrilled with fiat currency, but commodity based currency has its own set of different problems that are just as bad if not worse.

England allows the owner of land to keep (or sell) finds on their property, but they would also like you to contact professionals so the site could be studied in situ. Digging all the finds up like he did has destroyed tons of information that will not be able to be recovered.

Sigh, where's 3wood when I need him? I don't really understand all the issues around tying a currency to a commodity (like gold or silver). I read an article recently (maybe Thomas Sowell - can't remember or I'd try to find a link). It was a response to Ron Paul supporters who support a return to the gold standard. The point of the article was (and my numbers are probably off a little, but the point's the same) that the GDP of the U.S. last year was around 12 trillion, and the total value of all the gold EVER mined is around 7 trillion, so a return to the gold standard would force an instantaneous contraction of the economy by about 60 percent - if we already owned all the gold in the world (which we don't).
So, in my really lacking understanding, my question to the smart lizards here is - wouldn't the same concept apply to any commodity of finite supply?
To "back" a currency with a hard asset (like gold) simply means that, at any time of the currency holder's choosing, a unit of that currency can be exchanged for a comparable unit of the asset.
Does that mean that you have to have as much of that asset as you have units of that currency issued? No. The fundamentalists will tell you "yes" but they are wrong. And there is no avoiding it.
Here is why.
Banks are supposed to be able to provide depositors their funds on demand. But banks are in the business of lending out those deposited funds and making money on the difference in interest paid versus charged. The only way to do this is to hold a percentage of those deposits - to more than cover what one would expect in the way of withdrawals in a given period of time. When the economy is stable and the bank is perceived as solvent this works out fine. In fact, it works out so well that it actually makes the economy larger - with money available to borrow, people start businesses and employ people. Or they build houses and live in them, which also employs the people who build houses and provide goods and services to home owners.
Now if a bank could only lend excess funds (accumulated profits) then you would see far less economic capacity. In general, Money Supply metrics measure this economic capacity.
Getting back to the "hard asset" backed currency, theoretically the government would have to hold as much of the asset as there is of the currency. But it can't. With credit cards and other forms of lending there are dollars out there that the treasury has never printed. If you have $500 in a savings account and the bank has lent out $400 of it there are $900 out there. And if you are a public employee, then the $500 you were paid and saved was probably borrowed from someone else. So unless you eliminate lending of borrowed funds from the economy you will never have this fundamentalist nirvana of a fully solvent economy.
Economies that prosper are based on trust. Trust in the person you are doing business with. Trust in law enforcement. Trust in your employer. Trust in the courts. And when people feel good about society they spend more and take more risks which creates prosperity.
Pegging the dollar to a hard asset won't do anything to change that although it will prevent the government from acting like a bank. But we need the government to act like a bank and show trust in the economy when no one else has it. That is what the last 12 months have been about. Fundamentalists freak out about it, but letting all bonds of trust disintegrate in the economy so as to start with a clean slate is akin to amputating a hand to treat a hang nail.

If that person holding those dollars wants to get value for them as it stands now, they'd need to buy something using those dollars. Theoretically that means that (ultimately) those dollars will be spent in the US (you can buy oil from Saudi Arabi in dollars, but now the Saudi's have to spend the dollars).
If you let that person instead redeem those dollars for gold, then no new economic activity results.
If you are debtor nation (we are) going to a gold standard will quickly deplete your gold supply.

Okay, things are now officially scary...
One of my coworkers is on funeral leave. His grandfather passed away, but he didn't give us any information for where we could send flowers or condolences.
Using Google, I was able to find out the grandfather's name and funeral location knowing:
* date of death
* state of death
* grandson's last name
and that's it. By reading through the obituary I was able to match several other data points, so I'm pretty sure I got it. But that's amazing how little you need to know to find people.

Yes, better. Migraine is gone, but I think I need to tweak the time I take the meds with the current combination I'm on. I think one of the meds is messing up my sleep.
I have meds I have to take in the a.m. on an empty stomach, with no food for an hour after.
Then I have meds I take in the a.m. WITH a meal.
The evening schedule isn't as difficult to manage.
But I'm curious what's going to happen to me if I ever get senile. I guess somebody will figure it out.

UPDATE: Now the White House is saying the official "misspoke." Key grafs from the updated brief:Tommy Vietor, a White House spokesman, called JTA later to say the official "misspoke" and that administration policy on the Goldstone report remains as articulated last week by Susan Rice, the U.N. ambassador.
Rice described the UNHRC mandate as "unbalanced, one sided and basically unacceptable. We have very serious concerns about many of the recommendations in the report. We will expect and believe that the appropriate venue for this report to be considered is the Human Rights Council and that is our strong view."
She did not mention what the United States would do were the report to be referred to the ICC.

They blurred out my number plate. They also don't have my street number in the right place, but then, none of the digitized maps I've found do.
And I'm not correcting it, but I'll tell anyone using GPS to find my house that the GPS device isn't correct.

It would be worse if the Google Earth picture was of you at your computer, looking up Google Earth. And on your computer was a picture of you at your computer looking up Google Earth. And on that computer - well, you get the idea.
