It would most likely only be civil contempt. Criminal contempt requires proof beyond a reasonable doubt. Which is why you don’t see it too often. Most likely if he refuses to produce docs, he will get hit with monetary sanctions. He may get haled into court to answer for failure to comply, and if he doesn’t show, the judge could issue a bench warrant. But that’s an incredibly extreme measure.
