How is that a red herring? If you’re black, and thus not a legacy, you’re being discriminated against if you apply to an elite college. Just because this particular form of discrimination is localized doesn’t mean it doesn’t exist. And for what it’s worth, affirmative action tends (where conservatives haven’t prevented it) to do its work at those same elite colleges. Community colleges don’t really do much affirmative action because they don’t need to.

Problem is, they are discriminated against. Affirmative action is an attempt to correct some of that discrimination.

I understand that point but I don’t think it’s acceptable for a public institution to discriminate against people based on race. I believe the government had good intentions for arguing for AA policies but that’s not helping someone who gets passed over when they’ve done nothing wrong. Are college quotas fair to Asian students?

Unless a public institution can prove an absolute need for racial quotas (like your local PD or the military) I think the practice should remain banned.
