There’s nothing to slam. You’re claiming something has been said— that the USSR and US’s legal systems were equivalent— which wasn’t said.
What was said was that there is, in the US, the same problem that it’s human beings in charge, and they can be corrupt, venal, mistaken, abusive, et al.— as can be clearly seen with the judge who was getting kickbacks by sending kids to prison.
So, the death penalty, even in the US, has the problem that it will wind up being used on innocent people.
