Unless you can show a direct connexion (someone yelling at a rally to attack the police, say, followed immediately by an attack on police), you can’t prove it.

I think you’re confusing many different things here. We are talking about ought, not is. We are certainly not talking about the American system. So what is easy or difficult to prove under American rules is irrelevant to the discussion about the general principles.
