It still doesn’t not allow the SCOTUS or any court to CREATE laws or RIGHTS, and it certainly doesn’t extend a case like Roe, which abrogates the 10th Amendment. That allows them to rule on the Constitutionality of law, not make shit up.
So where did we get the implied right of privacy or Judicial Review from?
That was my point about Marbury vs. Madison. Since that has been unchallenged precident since the Adams administration, the fact is that the court really did give itself that right.
