From Scalia’s comments they don’t know what all is in the bill anyway, so that makes sense. If it’s upheld in entirety or thrown out in entirety, the GOP might be sorry they went this route. Democrats could rally around the popular shit that I mentioned being thrown out. What will the GOP say? We didn’t mean for all of the good shit to be thrown away and we promise to get it back?

They wouldn’t really have to say much. Neither party really wields much power over the Supreme Court. But they would have to articulate a way to keep some of the useful provisions. It really will depend on the course SCOTUS takes, but both parties would do well to start quietly drafting legislation in case of need.
