He’s not an attorney so he’s probably repeating what he heard from some talk show host. That’s the problem with most of us: we repeat what we have seen on TV or on the Internet, without being able to evaluate the accuracy of the information. If you hear something from several sources, it corroborates your beliefs without your realizing that the origin of the story may be from a single flawed report.
