It’s going to depend on the jurisdiction involved (where Sherrod brings suit). She’s got the damages part - namely the loss of her job unless USDA reverses, which is often the more difficult part to prove. Some states do have a criminal defamation statute on the books, but it isn’t often utilized.

Libel/slander cases are quite tough to prove in general in the US, so I don’t give her great chances for success.
