I’m crossing my fingers that there’s a plea deal. Article 85 of the UCMJ defines desertion very clearly and if the Army can prove that Bergdahl left his post with the intent to remain absent then he’s guilty as charged. Even if he is guilty I’d say that a reduction in rate to E-1 and a Dishonorable Discharge are punishment enough.
