Jones’ may want to hold appeal to claim inadequate counsel, but the problem is that Jones refused to comply with discovery in the first place, and was obligated by the court to provide this information. That his lawyer screwed up doesn’t change that except perhaps to open him up to criminal prosecution for perjury (which would have occurred had discovery been done in the proper course of events and Jones still lied about the phone contents - because that’s what he does and who he is).

This case will be an example for what not to do as a lawyer.

This case will also be an example of what not to do with a client.

It would have been far better to keep Jones off the stand; by taking the stand, he opened the door to all of this. His lawyer knew or had reason to know this.
