Isn’t is a sad state of affairs when we refer to judges as liberals, moderates or conservatives? Judges are now de facto politicians and I don’t like it one damn bit.

It’s the two visions, Archie. They have different underlying differences in the very way they view the law. In the case of equality and the law, the constrained vision sees it as equality of the process, while for the unconstrained it is the equality of outcome.
