It’s a tricky thing, technically yes, you’re arrested when your freedom of movement has been taken away. That’s the etymological root of the word arrest, to stop. However in practice it’s often up to the person to determine that they’ve been constructively arrested by asserting their rights, especially to remain silent. Police use this wiggle room whenever it suits their purposes.
