I never said it was a good idea or socially acceptable (I think it is neither. I find the idea repellant, personally). As a legal matter, he is probably protected, and especially since he is mixing a political message into the matter.

I don’t know the legal ramifications at all, I’m just horrified at the sheer tackiness of it.
