President Obama Makes Dramatic Immigration Policy Change

Romney’s far right anti-immigrant policy thrown into sharp relief

The big news today is the announcement that the Obama administration plans to stop deporting many young illegal immigrants, basically implementing the DREAM Act by executive order.

As we’ve noted previously, Mitt Romney’s immigration policy is being set by one of the most extreme right wing anti-immigrant ideologues in America, Kris Kobach. With this move, President Obama is offering a clear choice between the dead-end far right policies of Romney and a saner immigration stance for the United States.

WASHINGTON (AP) — The Obama administration will stop deporting and begin granting work permits to younger illegal immigrants who came to the U.S. as children and have since led law-abiding lives. The election-year initiative addresses a top priority of an influential Latino electorate that has been vocal in its opposition to administration deportation policies.

The policy change, announced Friday by Homeland Security Secretary Janet Napolitano, will affect as many as 800,000 immigrants who have lived in fear of deportation. It also bypasses Congress and partially achieves the goals of the so-called DREAM Act, a long-sought but never enacted plan to establish a path toward citizenship for young people who came to the United States illegally but who have attended college or served in the military.

The extraordinary step comes one week before President Barack Obama plans to address the National Association of Latino Elected and Appointed Officials’ annual conference in Orlando, Fla. Republican presidential challenger Mitt Romney is scheduled to speak to the group on Thursday.

I heard about this on NPR while driving to the vet this morning. My first thought was, Thank God!. 2 year work-permit if they've been here since before they were 16 and have no criminal record.

Isn't that what George II wanted?

It made sense then and it makes a lot of sense now.

Any bets on how soon Arizona passes a bill declaring all illegal immigrants who don't self-deport to automatically have a criminal record?

Awesome. A child should not have to live in fear because they were born here illegally or their parents brought them here when they were little. It's not fair to punish a kid for whatever sins the parents may have committed.

You can't be born here illegally. You can be brought here illegally, but if you exit a vaginal canal on US soil, you're legal. Period.

Incidentally, I am all for renaming the Rio Grande "Vaginal Canal"

If you enforce selectively by personal preference, it becomes rule by men, not law.
The President takes an oath to uphold the constitution which says that he president is to see that the laws are faithfully carried out.

John Yoo, one of the authors of the Torture Memos, heaps scorn on Obama's executive order:

President Obama’s claim that he can refuse to deport 800,000 aliens here in the country illegally illustrates the unprecedented stretching of the Constitution and the rule of law. He is laying claim to presidential power that goes even beyond that claimed by the Bush administration, in which I served. There is a world of difference in refusing to enforce laws that violate the Constitution (Bush) and refusing to enforce laws because of disagreements over policy (Obama).

Under Article II, Section 3 of the Constitution, the president has the duty to “take Care that the Laws be faithfully executed.” This provision was included to make sure that the president could not simply choose, as the British King had, to cancel legislation simply because he disagreed with it. President Obama cannot refuse to carry out a congressional statute simply because he thinks it advances the wrong policy. To do so violates the very core of his constitutional duties.
