I have a feeling that Kavanaugh is in some deep shit if he doesn’t get this appointment. Someone paid off his debts. Someone bought him a $92k membership to a private club.

He is on the hook to someone and he is going to lose a lot if he doesn’t get this.

11
ObserverArt  Sep 27, 2018 • 2:47:07pm

Just sent an email to NBC News and asked if their panel would ever ask about the elephant in the room?

Merrick Garland. Held up a nomination by Mitch McPublican to get their boy.

Goes to Lindsey Graham’s hammy weeping outrage about the Democrats now holding up the proceedings* to get to the election and hopefully get a better candidate.

And I told them, it might even liven up your ratings for News-O-tainment.

I bet this is happening elsewhere too. Anyone hear that comparison made by the media today? I’m hoping there are some yes answers.

*I’m pretty sure even the Republicans know the possibilities are fairly good it will work for the Democrats like it worked for them.

Those traits are fine as long as he votes their way on Roe, Citizens United, and other things that matter to them. Kavanaugh could have Lionel Hutz’s knowledge of the law but if he talked the conservative game on the judiciary, he’d be good. That was Harriett Miers’ mistake. She was unqualified and a bad pick but she would have gotten right wing support if she had given them the talking points they wanted and to her credit, she didn’t.

Brett Kavanaugh’s seething rage & fury throughout his testimony & his blatant disrespect for senators asking questions pursuant to their constitutional duty are wholly unacceptable. He lacks temperament to be judge anywhere.

2:37 PM - 27 Sep 2018

Isn’t this the Clarence Thomas playbook? He got away with this and is seated on the SC. Brett may very well succeed too, although in this case he’s not a minority fighting against a panel of people who don’t look like him.

The Ghost of a Flea  Sep 27, 2018 • 2:52:07pm

I know I repeat myself, but…this is exactly what the right wants.

The basis of their worldview is that their rage has inherent veracity, and that their righteousness emanates from their identity. Because these assumptions cannot be questioned, all skepticism is attack, all attack is existential threat, and that threat justifies any counter, including retaliatory acts that undermine the very principles and morals that (supposedly) are the fixed point of that inherent virtue.

The signifier engulfs and consumes the signified. Symbols matter more than what is symbolized.

An incontinent man demanding respect while giving none, demanding power while refusing to accept questions about his qualification, openly declaring his biases even as he claims to be impartial, is the perfect crystalline representation of how completely empty of substance these folks are.

The baseball game story is just vagueness about it was a great time. See I go to baseball games a lot too and I always have specific memories, maybe it was some good natured heckling that I engaged in or maybe an awesome play or some cool people we met at the game, the last game I went to, we sat next to some native Spanish speakers and my SiL’s sister’s husband was able to tell us where they were from. Buncha white people enjoying the O’s with some people from the DR. Kavanaugh is just saying it was a great time, comradery, etc.

You think Avenatti is just waiting for Kavanaugh to be voted out of committee before filing a criminal complaint on his client’s charges?

I think even if they do rush him through, this isn’t done.

I’m thinking Montgomery County PD is going to want to talk with accuser number 3 and Dr. Ford. I’m thinking Dr. Ford was fairly lucky and there’s more victims out there that may not even know that Kavanaugh, Judge, and his sick friends took advantage of them.

KGxvi  Sep 27, 2018 • 3:17:04pm

Ok, this is slightly off topic, but it has to do with a case before the Supreme Court this term. You may remember recently that Orrin Hatch submitted an amicus brief arguing that the Court should overturn the dual sovereignty doctrine. Erwin Chemerinsky has his preview of the Court’s docket out, and I found this interesting:

Most recently, in Puerto Rico v. Sanchez Valle (2016), the court held that the United States and Puerto Rico are not separate sovereigns for purposes of double jeopardy. But Justice Ruth Bader Ginsburg, in a concurring opinion joined by Justice Clarence Thomas, urged the court to reconsider the separate sovereigns doctrine.

Why don’t you take care of them.

All I said was I felt some sympathy for them. I feel worse for Ford and her family throughout all this. Okay, he’s being obtuse. Say I have a party at my house. Say Bob has too much too drink and pukes off the balcony. Me and a few other friends were inside when it happened. We claim Bob didn’t puke off the balcony because we didn’t see it. Dr. Ford’s story is they locked her in a room, turned up the music, etc. So of course these other people didn’t “see it”, if her allegation is true, they didn’t want people to see it. It’s a pretty weak defense if you ask me.

You know what bothers me? Even if we do stop this. What’s to stop Trump and McConnell from trying to get one approved during a recess. I mean it wouldn’t be illegal. That’s actually how John Marshall was approved but man it would be yet another scum move by McConnell who has shown he has zero scruples.

I still think it will be done in America. Just not above boards.

Call it the old fashion D&C. Who is going to know?

And it is about proper connections that will keep it on the down low.

In other words, just like before Roe v. Wade.

I remember the days before Roe—meeting sleazy doctors in the middle of the night with cash in hand; I remember driving a roommate to one of those “not above boards” encounters; and I remember her almost bleeding to death afterwards. Yeah—they weren’t all old fashioned D&Cs—they were back-alley butcher jobs.

I. Do. Not. Want. To. Go. Back.

The GOP has decided that getting Kavanaugh on the the Court is worth losing the Senate.

Because that gives them farther-reaching power for a generation or more, power that could help them retain or reclaim a majority in both houses of Congress, perhaps even a supermajority with rubberstamped gerrymandering allowed by a RW-controlled SCOTUS.

Fuck, just typing that depresses the fuck out of me.

I have to say that for most issues it wouldn’t matter which Federalist Society hack was placed on the Court: they will all vote to overturn Roe v Wade, the ACA, any voting rights protection, environmental protections, worker protections. It is only when it comes to Presidential power that Brett diverges from the pack and the other GOP judges on the SC may not hold with his views. Trump is going to get additional judges and it will become a 6-3 or 7-2 SCOTUS for our lifetimes. Let’s face it, we have one chance to preserve our country — and that requires a blue wave in both the House and Senate this November. And given how the SC is going to be ruling on voting rights, even that may not be sufficient to save us.

Those Bernie supporters who failed to vote for Hillary are the ones who most infuriate me; they still don’t accept responsibility for the disaster we are facing.

I was talking about how good upstanding women in the community handled the need for an abortion prior to Roe v. Wade.

Never meant to deny back alleys for everyone else.

In other words eliminating abortion does not eliminate abortion. It just changes the options depending on status and affordability.

And look at all the specialty medical service facilities available now where it could be done with the right doctor and right money. That is what I meant by above board.

Back when we were younger prior to Roe v. Wade there was not that kind of availability for medical services. You had hospitals that doctors worked with for the facilities.

Now they can do it privately.

As long as the sign out front doesn’t say “Planned Parenthood” or a similar marker as an “abortion mill” all is good.

All I’m saying is, way to many versions of “God gave me special permission to fuck you” out there for the base-rate declaration of faith to be an indicator of anything.

But I think that’s the fucking point. These are people that created an entire cultural grouping in which a symbol is no longer a symbol, it replaces the concept that it symbolizes. They’re moral because they adorn themselves with labels—family, values, pious—titles—father, deacon, party member in good standing—and flair—crosses, flag pins—not because they actually have coherent morals.

A lie isn’t a lie because the liar has the right affiliations. A specific immoral act is impossible because of the general categories the accused possesses.

This is the good-old-boys system, codified. It’s the implicit calculation that underpins aristocracy and autocracy: your position defines your culpability.

I suspect there’s a few reasons.

Perhaps they’ve had something similar happen to them, and they have rationalized it in order to deal with the psychological trauma.

Perhaps it’s a No True Scotsman blind spot - conservatives respect women, therefore, either what he did was respectful or he didn’t do it. And if it happened, then it’s obviously a misunderstanding and blown out of proportion because, again, conservatives respect women.

Perhaps, as you’ve suggested they’ve never experienced assault of this nature.

Or, perhaps, they are true believers and the ends justify the means, as they so often due with true believers.

They think that by attending these parties the victims got what they deserved; they believe that a woman who is too intoxicated to give consent has actually given consent. They are totally contemptuous of other women for finding themselves in situations where they can be assaulted. They pass on to their children this same set of beliefs: Rape is the woman’s fault if she attends an unsupervised party with young men. I’d love to know how the Arby’s social media/PR department manages to convince management that tolerating the Twitter account Nihilist Arby’s and encouraging corporate tattoos helps the Arby’s image. It’s brilliant! Arby’s is like that one cool uncle, who does all the stuff your parents forbid.

Fox News contributor fired for saying the quiet part a little too loudly.

“Feminists are their own worst enemies, and enemy of women, Also, they want men to NEVER be believed. I’m not succumbing,” he tweeted. “TO HELL with the notion that women must be believed no matter what. Lying skanks is what these 3 women are, and we ALL know more.”

He also said Ford, a professor of psychology at Palo Alto University, has a “BE degree.”

“It’s not a Bachelors of Science, but a BOVINE EXCREMENT degree,” he wrote.

Fox News told the Daily News that Jackson had been fired from his gig as a contributor following the tweets.

“His comments on today’s hearings were reprehensible and do not reflect the values of FOX News,” a network spokesperson told the Daily News in a statement.

Apparently they all decided yesterday that their position going forward is she’s a poor victim of a DNC conspiracy to use her against an innocent man. That they truly believe something happened to her, but know BK wasn’t responsible and the “real rapist” is out there somewhere, and that it would have been better for everyone if they’d had the opportunity to dismiss her allegations in the privacy of a closed-door session than out in public.

It’s just this simple to me: I believed her. I didn’t believe him.

She had no reason to lie. He had every reason to lie.

He’s a Trump nominee and Trump hasn’t dumped or trashed him yet. That’s better than any polygraph. They’re both born to lie.

Most of all, for me, his whole BS story about his drinking and his lack of sexual experience well into his college years rang like a cracked gong.

He and I had a lot in common in high school. We were both jocks, we were both at or near the top of the class academically, and we both drank mucho beer (which I guarantee you means plenty of harder stuff than beer too). The only major difference was that I was twenty years ahead of him, quite a generational gap. I might have barely bought at least some bits of his story if he’d been in high school in the very early sixties, as I was. In the eighties? Fuhgeddabout it.
