This. The problem is that Biden can only do so much by fiat, especially since he’s going to be forced to play by rules Trump never had to. And we can barely pass much less controversial things with the Senate margins we have, much less eliminate the filibuster, much less expand the courts which would likely require the elimination of the filibuster in the first place.

We are institutionally roadblocked from almost all avenues of escape or address.

I would be remiss if I didn’t add that Justice Breyer is in the process of handing the corrupt majority a seventh seat by insisting on remaining on the Court with no justification whatsoever.

He deserves the most unremitting scorn.

This is not only a verdict on his selfishness and self-regard. His rationale for remaining on the Court at the risk of further empowering the corrupt rightwing majority is emblematic of a further problem. It is on a par with those liberal legal academics who in recent years have penned editorials confidently informing us that while they disagree with now-Justices Gorsuch, Kavanaugh and Barrett they are nonetheless learned and brilliant jurists of integrity who deserve our support in ascending the bench.

The design of this insane law was not really deliberate: the GOP were trying to figure out a way around Roe and this is what they got. It’s not the state that is banning abortions, nossir: there are just private citizens who can now wage lawfare against random women and anyone who helps them to drive them into bankruptcy, but nope, not the state.

So it’s going to be every chancer, and nutjob, neighborhood snoop, stalker, and crazy ex who will be filing suits all over the state. And it’s not only an anti-abortion bill, because every woman from menarche to menopause is now at the mercy of literally ANYBODY to prove that she hasn’t had an abortion. It is total mob rule over every woman’s reproductive rights.

And, of course, blackmail. Maybe $5k now and a greedy creep won’t sue for $10k+ and court costs. Much quicker. But, of course, now everybody, including the target woman, her partner, and her family can get a gun no questions asked. Which is quicker too and pretty permanent.

As of a few moments ago, the following major highways are still closed/partially closed in the NYC metro areas:

Routes 18, 21, 22, 23, 202, and 206 in NJ
In NY: Bronx River Parkway, Saw Mill Parkway, and the Hutchinson River Parkway. Other highways are seeing massive delays and congestion, especially where local roads may be impassible.

It’s a mess.

there are some other work arounds, but we need cooperative senate majorities to do so. We always have the ability to restrict what things the Supreme Court does with its time. Nothing in the constitution says the court exists to be some kind of final arbiter over what legislation is allowed and what isn’t. They can be neutered. Whatever constitutional crisis ensues wouldn’t be any worse than what we already face. Also, godamnit, musiciansfriend, when i specifically ask if the hard case they’re showing me is a bass case, you’d damned well better mean it when you say yes. Well, not to worry. On the exchange, I’m getting a tweed case which just looks really handsome.

Five Justices Did This Because They Could

The shadow docket has begun to look less like a place for emergency cases than one where the Republican-appointed justices can implement their preferred policies without having to go through the tedious formalities of following legal procedure, developing arguments consistent with precedent, or withstanding public scrutiny. And so after initially allowing the Texas law banning abortion before most women know they are actually pregnant to go into effect, five conservative justices told Republican-controlled states they could disregard Roe while insisting that wasn’t what they were doing at all.

Instead, the justices in the majority argued in their unsigned opinion that because the case presented “complex and novel antecedent procedural questions,” their hands were tied. This is ludicrously dishonest. If Texas passed a law granting $10,000 bounties to private citizens if they sued anyone who held or enabled an indoor church service during the pandemic, the Court’s conservative wing would not feign confusion about whether the constitutional right to freedom of worship had been violated because of the supposed novelty of the scheme.

Just found out one of our friends tested positive for Covid-19 - she’s vaccinated, but still feels like crap - no taste, stomach ache, headache - and her husband isn’t vaccinated. I told her to not fuck around and take him in for monoclonal antibody treatment asap.

They’re kind of red-necky and were up in Chico visiting family over the weekend, which means a bunch of unvaxxed people there are probably sick now, and some of those people could die. Stupid fuckers.

This. The problem is that Biden can only do so much by fiat, especially since he’s going to be forced to play by rules Trump never had to. And we can barely pass much less controversial things with the Senate margins we have, much less eliminate the filibuster, much less expand the courts which would likely require the elimination of the filibuster in the first place.

We are institutionally roadblocked from almost all avenues of escape or address.

We would need a strong majority in the Senate to pass such an expansion, and I am skeptical about the long-term merits anyway. But in the here and now, such an expansion could be disastrous, with a 50-50 split in the Senate. McConnell will use every trick in his book to interfere with the process until there is a Republican president. If somehow he becomes Majority Leader, there will be no way to get another Democrat on the court. The only hope is for 2 of the GOP justices (preferably not Roberts who is not the worst) to leave the Court in the next couple months — and that is not a high probability event.

I’m currently playing a PS4 game called The Last of US, Part 2. Think The Walking Dead, only more intense and gut-wrenching. The majority of the game takes place in a post-apocalypse Seattle, where much of the streets have been turned into raging rivers due to infrastructure collapse.

These photos look at like this. If I have my bearings right, that’s the Green Lane Bridge, which leads into the Manayunk neighborhood It was a mill town with a canal that became part of Philly in the 1854 consolidation. It’s notoriously flood-prone. I cannot imagine what the section of the city looks like now.

I think in general, the point is that we need to stop assuming that these big acts are somehow desperate last gasps of a dying party that we just need to outlast to finally get over. This isn’t a desperate last act, this is a triumphant act of a party and movement that is seeing a way to finally drive a nail in the coffin of all its opposition. This is the act of a group that’s feeling ascendant and emboldened and, despite a recent big loss, sees a pathway to absolute, entrenched power. This was the first big test of that, and they succeeded by all bounds.

They’re not doing this because they’re desperate. They’re doing it because they can. They’re doing it because they don’t see a way we can stop them anymore.

South Africa collapsed in large part to international scorn and an organized opposition within and outside the country. Our right wing wishes to turn us into another South Africa where an entrenched minority calls all the shots due to structural realities of our Constitution and state governments.

Should the right wing’s plans come to fruition there would be little to no protests within the country as local police will actively suppress them with the aid of Oathkeepers, Proud boys, etc. These terrorist gangs would see their ranks swell as the bottom feeders flock to the victor’s side helped by direct red state government support as they see their chance to finally get revenge against intellectuals, minorities, women, academics, artists and actors and anyone else deemed the enemy.

There would also be just limited opposition outside the US as various EU and other countries also have their own building fascist problems with countries like Germany seeing a frightening resurgence of right wing evil. The demographic reality is not the automatic block against this fascist movement taking control. And the lack of street protests or crowds filling the DC Mall this very moment shows that people are either in denial about what is coming or too disinterested and distracted to care.

It is interesting that not one Texas Republican in congress has gone on Fox to spike the football after this big “win.” More interestingly, Fox hasn’t mentioned anything about the abortion case since a 20-second piece at 5 AM this morning. I guess the dog caught the car.

It took 90 years after Reconstruction ended to eliminate Jim Crow and restore civil rights to African Americans. We do not have 90 years to stop the evil that is being perpetrated by the GOP nationwide, with the enthusiastic assist from a corrupt Court, a Court as evil as the Taney Court and the Court that approved Plessey vs Ferguson.

Just going to point out that the anti-abortion crowd uses Dred Scott as a reason why Roe should be overturned. “They were wrong on Blacks being slaves and they’re wrong today about embryos and fetuses.”

I’m not saying don’t use Dred Scott. Instead, flip it around on the anti-abortion people and point out that they are enslaving women and our bodies to their theological belief system. Not only that, they come unglued if you talk about vasectomies for men, because that’s just wrong. It’s unnatural for men to have to lock it up, apparently.

I’m also that woman who will bluntly tell anti-abortion people that I don’t get my morals from guys who had a procedure to shuffle child rapists around or guys who hide child sex abuse in their churches. I just DON’T.

Very nice. On a foodie note, for those of you who like spicy food (any lovers of Momofuku here might take note), Mrs. Fish and I found two new things that might tickle your fancies: Flatiron Pepper Company, which makes flavored blends of pepper flakes (including one named “I can’t feel my face” which is a blend of Carolina Reapers, ghost peppers, habaneros, and something else), and Samyang Spicy Korean Ramen. They have a regular spicy (black package) and 2x spicy (red package); the 2x spicy is probably the hottest thing I’ve ever eaten in my life. However, the quality of the instant noodles is AMAZING and the flavor is really good, besides just being melt-your-face-off hot.
