Longest sentence handed down for a 1/6 terrorist to date. If the violent terrorists thought that the wrist slaps the “tourists” were getting would mean light sentences for them, they were sadly mistaken.

The woman - referred to in filings as Gabriele P. - will have to pay court costs for both herself and Clapton, reportedly totaling almost $4,000

***

A 55-year-old German widow - named in reports as Gabriele P. - has reportedly been mandated to pay for court costs for both herself and Eric Clapton, after the electric guitar player successfully sued her over the sale of a live bootleg CD on eBay.

According to the German newspaper Bild, the bootleg, Live USA, was purchased by the defendant’s late husband at a department store more than 30 years ago. Gabriele then went on to list the album on eBay for €9.95 (~$11) in July, after which Clapton - citing the illegal nature of the album - sent the court an affidavit.

The Düsseldorf Regional Court ruled in Clapton’s favor, and yesterday (December 15) rejected Gabriele P’s appeal on the initial ruling, saying that the facts that she neither bought the CD herself initially nor knew, at the time she listed it on eBay, that it was a bootleg, were immaterial.

Gabriele P. now reportedly faces either a €250,000 fine or six-month prison sentence if she continues her efforts to sell the album.

Trying to check on the Asahi website. It was a multi-purpose building and apparently a man entered a clinic located on the fourth floor with bag containing flammable material, stomped on it so that it spread out, and then lit it on fire. Most of the victims died of smoke inhalation, it seems. A motive is not given. In fact, their not even certain if he died, is one of three now in hospital, of fled.

I agree that this is pretty dick move on Clapton’s part. Yeah, we all know that bootlegging and piracy of content is a *serious* issue, but putting himself out as the headliner in case against some random eBay lister over a €10 CD? (I think he should have gotten someone else: agent? manager? lawyer? to front for him) - just makes him look (even more) like an asshole. Especially as the woman is on the hook for court costs.

Top line takeaway. The surge in cases is primarily among unvaccinated. The surge in hospitalizations is overwhelmingly among unvaccinated. Omicron will mess your shit up. Delta will mess your shit up.

Don’t let either mess your shit up. Get vaccinated and mask and take proper precautions. The life you save may be your own.

You have 48 people in the Democratic caucus who are prepared, and a president of the United States prepared to think big. And you have two Democrats who, in my view, are kind of acting like Republicans. And to me, I respect other people’s points of view, but I do not respect the arrogance of any member of the senate who says, “You know what? I’m going to torpedo this entire bill, supported overwhelmingly by the American people…”

You’ve got two people saying, “You know what? Hey, if you don’t do it my way - I don’t care what the president wants, I don’t care what 48 of my colleagues want - it’s my way or the highway.” And that, I regard as arrogance. You can disagree. Look, I have disagreements, as you well know. You fight for your ideas but you don’t say, “My way or the highway.” And that I feel very strongly about.

That process is a hell of a lot slower than the breakdown due to atmospheric oxygen and aerobic bacteria here on earth. Radiation doesn’t actually turn your organs to mush; it damages your DNA so that your body turns itself to mush.

I have to admit I’m not as negative about cryptocurrency as some. I’ve been looking into it quite a bit recently and sure, there are lots of scammers, but there are lots of scammers using regular old US dollars too. I’m not completely sold on it, the value fluctuates wildly and I’m not about to convert all my cash to Ether, but it’s too large at this point to ignore. And as I said, yeah, it’s imaginary money, but so are greenbacks.

Not imaginary, but somewhat abstract. Fiat currency is at least backed by a government and banks with tangible assets even if the currency itself isn’t directly backed by gold or another commodity.

Crypto and NFT’s?

I cannot for the life of me understand a currency that is nothing more than data with a blockchain derived from a private party algorithm for ease of use by criminals.

I think you know I’m not a gold bug or advocate for that as anything other than a small part of one’s assets. (Metal not paper!) But with that option in hand, personally, I do not see the appeal. My other thought is that the pioneers got the arrows and the settlers got the farm.

Of course it’s in Austrailia.

The name “millipede” translates to a thousand feet (from mille “thousand” and pes “foot”). However, no millipede has ever been described with more than 750 legs. We discovered a new record-setting species of millipede with 1,306 legs, Eumillipes persephone, from Western Australia. This diminutive animal (0.95 mm wide, 95.7 mm long) has 330 segments, a cone-shaped head with enormous antennae, and a beak for feeding. A distant relative of the previous record holder, Illacme plenipes from California, it belongs to a different order, the Polyzoniida. Discovered 60 m below ground in a drill hole created for mineral exploration, E. persephone possesses troglomorphic features; it lacks eyes and pigmentation, and it has a greatly elongated body—features that stand in stark contrast to its closest surface-dwelling relatives in Australia and all other members of its order. Using phylogenomics, we found that super-elongation (> 180 segments) evolved repeatedly in the millipede class Diplopoda. The striking morphological similarity between E. persephone and I. plenipes is a result of convergent evolution, probably for locomotion in similar soil habitats. Discovered in the resource-rich Goldfields-Esperance region and threatened by encroaching surface mining, documentation of this species and conservation of its habitat are of critical importance

Crypto has a technical story and a political story. And its political story is that it is infested with libertarian dudebro tax evaders and worse, so I really hope it never catches on.

Similar to Christianity, the tech dudebros have done more damage to any validity cryptocurrency has than the actual concept of cryptocurrency itself.

Something like that happens at the end of “Dark Star”.

We’re past that point already. Those are all valid criticisms of how it started but it isn’t just the province of dudebros any more; there are banks in Europe that support both crypto and euros. The criminals no longer trade the most common types of crypto because controls have been tightened up a lot.

Ditto with the don’t approve of it. It’s bad enough that governments have outsourced control of the money supply to the banks. Nothing good can come out of adding a crypto Wild West to this already serious problem.

I feel like someone with another skin tone would be killed, and the cops would say he was on PCP.

Palmer pleaded guilty to his role in the attack on the Capitol on 1/6. The government said Palmer threw a wooden plank at officers, sprayed the contents of a fire extinguisher at the officers before then throwing the extinguishers. He then searched for more materials to assault police with including throwing a fire extinguisher a second time.

According to the sentencing memorandum, Palmer was eventually pepper sprayed by law enforcement, but that didn’t stop him. The government said Palmer assaulted another group of officers with a 4-5-foot pole that he threw like a spear at the officers. He was then shot by officers with a non-lethal bullet that hit him in the abdomen.

By the way, I don’t know if it’s been posted here, but the Fucker Carlson defense lost in court yesterday, when a judge denied a motion to dismiss in the case of Dominion Voting Systems v. Fox News Network. Here’s the end of a tweet-thread concerning the ruling:

It’s an interesting decision, from a legal perspective. The Judge basically told Fox that their asserted privileges didn’t apply and that they likely don’t have First Amendment protections as reporters for the comments Trump and Powell made on their shows. As far as not stating enough facts the judge probably could have left it at “the complaint is 134 pages long and has 300 pages of exhibits” but actually addressed the facts alleged.

Now the questions are whether Fox tries to settle, if Dominion is willing to settle, and if the settlement will be made public. My guess is “yes, yes, and yes.”

Even as the world panics over the rapid spread of the Omicron variant of COVID-19, the health ministry in South Africa has delivered some encouraging news. On Friday, South Africa’s Minister of Health Joe Phaahla said that hospitalizations are down with Omicron cases compared to previous waves like the deadly Delta surge, and that people in the hospital rarely need oxygen and are less likely to die from the disease.

Phaahla told reporters that the country’s hospital admission rate of COVID-19 patients “fell 90 percent in the second week of the current infection wave driven by the Omicron variant” as compared to the second week of the Delta wave. Boiling down the good-for-a-global-pandemic news further, he said that only 1.7 percent of all Omicron cases are being hospitalized, compared to 19 percent of Delta cases earlier in the year.

In my opinion, crypto is like the private currencies that banks used to print. Biggest problem is keeping track of what each is worth is a real task. In the 19th Century, before private currency was pretty much outlawed, it was a major business keeping track of relative values.

Of course every time a bank failed anyone whose wealth was mostly denominated in that bank’s currency lost all that wealth. With the attendant problems associated with that from failed businesses to poverty. As I recall the US had an economic depression about every twenty years during the 19th Century.

What’s really funny about crypto is that the people who endlessly complained about ‘the government printing money’ are now backing endlessly printing money. (snicker)

I agree. For me, the extreme volatility is a major concern.

And don’t fucking get me started on NFTs…

Anything that alleges to be a legitimate currency needs to be relatively stable in value. If it’s not stable, it may be an asset (like gold) but it’s definitely not a currency. The dollar has “depreciated” 6.8% over the past year — not the past hour or past day. Wild fluctuations do not make a desirable monetary unit.

Then why do mining operations continue? Or, aren’t they?

I’m not a tech expert.

But as I understand each it, new block that is mined and added to the blockchain is worth about 6 BTC. Because of how the system is designed, it gets progressively harder to mine new blocks. Eventually it will become impossible to mine new blocks and the Bitcoin max limit will be reached.

We’re not there yet, though. So the tech bros. will keep on mining.

And this is where I throw up my hands and yell a lot.

If you have a finite resource (Only 20 Bitcoin out of a fixed figure of 14,000 remain!), you turn into the World Worm eating its own tail, spending $50,000 to acquire a $40,000 asset. And then what? The asset has limited its own growth and can’t be worth more than what it was worth on the day the last of a self-limited 14,000 has been mined.

Granted, I am a bear of very little brain, but it makes my head hurt.

It’s worth whatever Libertarians are willing to buy it for, and the idea is that the value keeps going up due to the finite supply. One Traganic Pu, for an imaginary example, could have the value of our entire economy, as long as you’re able to do transactions in fractions of the Pu.

Bitcoin speculators are counting on that bolded part being false, which it basically is. Asset values in speculative bubbles are irrational, and the whole point of bitcoin is that its originators (who probably still hold some ridiculously large fraction of all bitcoin) intend to be the early winners in a bitcoin bubble they intend to cash out of in time.

The other part about Bitcoin - the part about “why are mining operations continuing” - is that the next Bitcoin is more difficult to mine than its predecessors, by design. So the growth curve is logarithmic, rather than exponential or even linear. This also rewards early adopters, who had to invest in less infrastructure to mine earlier Bitcoins.

A British guy used to own 7,500 Bitcoins he mined in the early days when they weren’t worth much. Then he threw away the hard drive with the “keys” to those Bitcoins. It’s in a garbage dump near his home. Somewhere. He’d like it back.

If one person or group could control 50.0001% of all Bitcoins they could leverage that control to own all Bitcoins everywhere, the minority owners would effectively lose everything.

Ok, I get what you are saying, but what you are describing is a complex Ponzi scheme controlled by the holder’s of the 14,000 original Bitcoin, who will make a new “issue” of not-Bitcoin, let’s call it Botcoin, that will be a limited issue of 28,000 that will cost $70,000 per unit to acquire.

I mean, it’s a great way to launder your drug money and increase your profit if you mined your Bitcoin at $20,000 per unit, because Bitcoin will rise to $70,000 to reflect the new normal of Botcoin.

Brilliant!
