Just like the idiot who sued Subway because his footlong was not exactly 12 inches long.

Not an idiot. False advertising.

Subway settled out-of-court with the class for $500,000 (because they were guilty) and even set up a Website at the order of the court to explain the action (now down as the term of the lawsuit has expired).

Forbes at the time called the case weak and they were lucky to get anything. (Forbes tends to cape for businesses.) Doctors’ Associates (Subway’s parent company) claimed the bread dough in each sub weighed exactly the same as their defence, therefore they got the same amount of bread.

The lawsuit claim wasn’t about weight. It was about falsely advertising the length. “Foot” has a specific definition in US law. Subway claimed the bread was a foot (or twelve inches) in their advertising, not how much the bread weighed. Notably Subway did not show any bread was over a foot (so thy could at least try to claim it was average).

“About a footlong” doesn’t really have the advertising bite though. At what point would you argue a “footlong” is not a foot and therefore a viable claim?

That you have no idea what he “stands for” because he’ll abandon it the moment he gets the least big of negative press or has to answer tough questions.

- will you be able to get out of your front door?
- to your car / out your driveway, etc
- are the local roads flooded or driveable
- and for how long

how much water does it take for this to happen

you’ll catch on pretty quick

we acknowledge most flood warnings/watches and then find they generally dont matter much, even if we get a lot of standing water

As Law Dork notes, the judge in this case took a different track than a judge in Alabama (same circuit) who held it is constitutional to ban gender-affirming care for minors.

The Florida judge noted the legislative animus throughout the process of writing this law (animus was not an issue in the Alabama case), and the ban on adult care (also not an issue in Alabama), along with parental rights.

The Alabama case is on appeal to the full Eleventh Circuit. The Florida judge wanted to make sure this is actually a different case than the Alabama case.

Difficult to tell. In the Florida case it seems the law was so sweeping that the judge could easily see parts were unconstitutional.

I suspect that Florida under DeSantis will then parse out the many aspects of the law and pass new, more specific laws.

Will it end up with the USSC banning care for underage people? Probably.

The burden of proof is being misapplied here — all Republicans should be presumed to be liars unless what they say is independently confirmed by a non-Republican source. Conversely, all allegations about Republicans should be presumed true unless disproven by non-Republican evidence.

The error rate for both prongs of this rule would be well under 1%.

It’s so weird, President Biden hasn’t tweeted once about his son’s “sham verdict.” He hasn’t attacked the judge or the jury, hasn’t called it a hoax, or vowed retribution. yesterday, convicted felon and internationally-acclaimed nautical electrocution expert Little Donny Fuckface took part in a ritual that every newly-minted felon in New York must endure: he met his brand-new probation officer and sat for a pre-sentencing interview.

he then had to pee in a cup, on the spot, to be tested for drug use. after the ordeal was over, he stood in front of the building and whined to the assembled media about how unfair the whole thing was. rigged!

From what I’m hearing, it looks like Hamas essentially rejected the Biden deal, sending back their take on the proposal that essentially rewrites the whole thing.
They’re essentially pulling the same kind of shit they pulled the last time, when they agreed to a “US proposal” that Egypt and Qatar changed without Washington’s knowledge or approval, and then rejected the response claiming “that’s not what we agreed to”. Egypt and Qatar were raked over the coals for that bit of bullshit, can only imagine how pissed off the White House is gonna be with the latter now. Worst mediators ever.
Word is that Qatar threatened Hamas leaders living in the country that they’ll be kicked the f*ck out if they don’t agree to the Biden proposal. Let’s see what actually goes down…

I’ve been stymied trying to buy locally a garden hose reel. No one has them.

My wife broke down and ordered one from Target, which is available in Scottsbluff (yay, a 120-mile round trip for this). Target says it’s ready now but it’s too late in the afternoon, so we’ll go tomorrow to get it.

(It’s already assembled so that should be fun cramming into a Smart.)
